Hello,

My Filipino husband and I live in the Philippines. I'm American. We are considering moving our lives to the US someday in the near future. Can I petition for him to come to the States while IN the Philippines? Would I do this in Manila?

What is the average wait these days?

Also, what would be the correct visa to get? The IR-1/CR-1 visa or the K-3?

Thanks... just beginning this journey so please understand if I'm still a bit clueless when it comes to this visa. :)

sure you can..do the DCF filing in Manila. if you have been married for over 2 years why not file IR-1 for your husband.

Ok Thank you for your reassurance. That's what I was hoping for... to be able to apply here in the Philippines. I thought the K3 seemed like it would not make sense. Do you know what the waiting times are for the whole process these days? The tourist visa was super easy for him (thankfully!), but I'm sure this one is more timely??

If you do the DCF way for filing the CR-1/IR-1, it will be over really fast. Not sure about time but it definitely won't be a year. Look up Direct Consular Filing on Guides (topmost bar)

Just to make it plan you will be submitting a I-130 petition. Really a K3 buys you nothing since you will be filing DCF which is lightening soeed faster than anything else. If you are married more than 2 years at interview your husband would be issued a IR1 visa.

DCF yes is your best bet figure start to interview 6 months. Compared to if you filled in US right now people are looking at 12 to 16 months and thats just to get approved through USCIS. There is still NVC and waiting for interview which could be another 4 months.

So when ready DCF. And hope you will be able to show domicile or re-establishing domicile. And also a co-sponsor unless your job is one that will continue when you move back to US.

Do read the guides on I-130 and if you have more questioons come back.

December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)

Wow, all of you are very helpful. Thank you so much! Ryan, I didn't pursue my permanent residency yet and at this point, I'm not sure I'm going to. I've been on the Balikbayan visa this year and we are about to leave and return and renew it. Do you know if Balikbayan visa would work?

You are all wonderful. Thank you so much. I really studied up when he was getting his tourist visa, but now its time to relearn this stuff! Ok IR1 it is. I have not even heard of DCF so thank you! I have a lot of respect for all of you who are waiting to be with your loved ones. I cannot imagine!

OMG. I was just about to post the same thing, good thing I came across this post! My son and I are going back to the Philippines, so that my fiance and I can get married.. but I'm not gonna come back here til Late on of next year, and was planning to file over there.

We got refused of the fiance visa twice, due to financial issues, and my parents just told me to go ahead and get married because they can't refused a co-sponsor.

I'm clueless as well of how this works, but I hope everything goes smoothly. Goodluck! :D
