K-3 Visa is it still an active or an obsolete visa?

According to what we have read before it says that this visa shortens the time of separation of love-ones. After filing the I-130 last March 29 we did try to file this K3 (I-29F) Visa last July. After we got the NOA 1, we didn't hear any progress on this visa.

My husband called the tier 2 yesterday inquiring on our I-130 petition and the lady said our case it is still at NBC and it might take a year before the approval. cray5ol.gif

The K3 USED TO shorten the time apart when the CR-1 used to take several years. Now, both processes take about the same time in the rare case a K3 can be obtained, but the K3 involved more paperwork and expense once you enter the USA. Because of this, the CR-1/ IR-1 is superior in almost all cases.

The K3 is also unobtainable in most cases; you may file it with the USCIS, but once it reaches NVC stage (a different gov dept) it will be administratvely closed in about 97% of cases.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

In 2012, out of all spousal visas, 0.33% were K3. That's about 210 out of just under 50,000.

Sort of obsolete. Any who file the K3 are converted to the CR-1 from what I have read.

So did you file two petitions, one in March another in July? Did you cancel the March petition?

They wouldn't want to cancel the I-130 from March, it's the precursor to the I-129F petition (for K3).

Beneficiary - Applying for CR1/IR1 (but also played the K3 card prior to understanding it may be phased out.)

2013: July 20: I-130 sent (Chicago lockbox)

July 24: I-130 NOA1

July 24: I-129F sent (Dallas Lockbox)

Aug 2: I-129F NOA1

Aug 12: Alien Registration Number was changed, I-129F.

2014: Jan 28/29/30: - 3 transfer notices for I-130 and I-129F.

Feb 3 - Hard copy arrived -Notice of transfer to Texas stating Jan 29th.

Feb 10 - NOA2

Feb 27 - email stating I-130 being sent to NVC from TSC.

March 6 -NVC received our case.

April 7 - CASE NUMBER yay! IIN and BIN obtained and email given.

April 9 - DS261 available and filled in online.

April 9 - AOS not yet payable but visible.

April 10 - email regarding NVC case number and access to DS261 received/ email regarding AOS received and paid.

April 11 - AOS sent by snail mail.

April 14 - AOS arrived per mail tracking.

April 15 - IV bill received via email, IV bill paid/ in process, IV package sent.

April 18 - IV bill showing paid/ DS-260 available and done!

- AOS scanned into their system.

April 21 - IV package arrived per mail tracking.

April 24 - IV scanned into their system.

May 2 - False checklist for IV documents= AOS approval.

May 13 - NVC rep reported ? missing Police certificate via my phone call.

- Supervisor review initiated.

May 14 - Checklist for Police certificate came via email.

- Sent checklisted documentation priority post!

May 15 - Package delivered per mail tracking.

May 19 - Case COMPLETE!! Police certificate found by NVC:)

May 28 - Case complete email arrived.

May 30 - Assigned Interview date!

June 2 - Interview letter arrived via email.

June 11- Medical appointment Surrey, BC

July 8 - Interview in Montreal!! APPROVED!!!!!!!! July 10 - Visa package and passport in hand!! July 23 - POE!!

Nah we didn't cancel any of these two visa. Hoping that one of them might be approve soon!

I am assuming they filed the I-130 and then the I-129F after getting the NOA1 to try and be on the K3 visa path.

Yeah cause we can't file a K3 visa unless we filed first a CR 1-Visa. That is a requirement to file a K3 petition.

I'm in the same boat, I filed I-130 and after I got the NOA1, I filed I-129F.

eventhough the chance of getting a K3 visa throu is minimal, I'm hoping that with the long wait periods for approving I-130, they will give the I-129F a chance to go throu.

Who knows?

Hi! I just want to ask where did you file your i-129. I was reading guides and other topics and i just wanted to confirm. Do you send the application where the marriage took place?

the I-129F has to be sent to the following addresses here in the USA: (from teh USCIS website): http://www.uscis.gov/i-129f
