Hi,

I'm a US citizen and my husband's Australian. I want to move to the USA next May 2014 (Melbourne, Florida). I plan

on filing for i130 for my husband so that he can become a permament residence in the USA (although he will be

working 9 months out of the year in Australia for awhile). We are wanting to buy a home in Florida but his income

will not be considered as he does not have a SSN number. Has anyone figured

out how to go about getting a SSN for foreign spouse until the permanent residency comes through? If the i130 only

takes about a year to go through until he can get one that is no drama as we plan on renting anyway when we arrive.

But we would like to buy a place within the first year we are there and I will not be working as I am caring for my

son who is disabled. As such, we are only relying on his income from his job in Australia to purchase a home. Thanks

for any help or advice.

Petitioners residing overseas in countries where USCIS does not have a public counter presence are required to file their Forms I-130 by mail with the USCIS Chicago Lockbox.

Your spouse can get ITIN. http://www.irs.gov/Individuals/General-ITIN-Information

IRS issues ITINs to individuals who are required to have a U.S. taxpayer identification number but who do not have, and are not eligible to obtain a Social Security Number (SSN) from the Social Security Administration (SSA).
ITINs are issued regardless of immigration status because both resident and nonresident aliens may have a U.S. filing or reporting requirement under the Internal Revenue Code.
How do I know if I need an ITIN?
If you do not have a SSN and are not eligible to obtain a SSN, but you have a requirement to furnish a federal tax identification number or file a federal income tax return, you must apply for an ITIN.
Who needs an ITIN?
•A dependent or spouse of a U.S. citizen/resident alien
• A dependent or spouse of a nonresident alien visa holder
