my fiance is 19, and hasn't had a job, therefore not filed any taxes.. will this be an issue for us filling for K-1.. Or are we better off "spontaneously" marrying?

If your fiance doesn't have a job to support you when come to US, who would think would help you? I know there are some countries allow co-sponsor but it is not the point.

I read many posts here when love blind sided them and after married, money became a problem and torn a part their marriage. I'm not saying money is everything but at least your fiance showing some responsibility when decide to bring you to US. Who will pay for the whole immigration process fees?

I'm sorry, I can't give you any better idea than this. Good luck for any path you will choose.

I agree with Girl from Celebes. The lack of earnings in itself is not a problem as you can always try to find a co-sponsor, but marriage is a big responsibility, and you both need a place to live, food, all that. There are visa fees and AOS fees to take into account. And while I hate to sound paternalistic and condescending, at 19, you might be a bit young for this, to have someone move across the world to marry you (just my own personal opinion). Could you move there with another type of visa, student maybe?

You're not better off marrying spontaneously either, unless you do that in Australia and then file for a spousal visa instead of a fiance visa. Doing it in the US, when you went there for a visit or with some other type of visa, will be considered immigration fraud.

Also, I am assuming that even though you're so young, you've met in person in the last 2 years?

I assume by "spontaneously" marrying you mean entering the USA on the VWP in order to marry and file for adjustment of status. This is also known as immigration fraud, and you won't find anyone here condoning or recommending this.

2014 1/9 Interview - Approved, 1/15 CEAC - Issued, 1/17 Visa in hand, 2/5 POE: LAX, 4/4 Married!, 4/8 AOS/EAD/AP filed, 4/14 NOA1, 5/7 Walk-in biometrics, 5/19 EAD/AP approved (expedited), 5/22 EAD/AP mailed, 5/23 EAD/AP received, 7/29 Interview waiver letter

2015 4/13 AOS approved (no interview), 4/22 Green card received

2017 1/17 I-751 ROC filed (VSC), 1/23 NOA, 2/28 Biometrics
