K1 does she have to leave?

Hi guys,

new here tonight was here 10 years ago and married a romanian woman but we just got divorced, sad. anyway i have fallen in love with a filipina woman and want her to come here on a k1 visa, i will marry her within the 90 days. does she ever have to leave during all the rest of the paperwork? i did a k3 marriage visa with my ex wife so not sure how this fiance visa works. mainly just wanna know if she can stay here and not leave after were married provided we do all the proper paperwork in a timely manor.....thanks all and nice meeting everyone, i know first hand how tough this whole process is...good luck to all.....pete

If the K1 visa is approved and she gets admitted to the US and you get married within 90 days then she doesn't have to leave even if she is undergoing the paperworks for adjusment of status.

Timeline

The first step in applying for a K1 visa is filing the I-129F petition. She can be with you while the petition is being processed, provided she has a tourist visa/some other kind of visa that gives her legal status in the US. However, once USCIS has approved this petition, she will have to return to the Philippines for the interview and issuance of the K1 visa. That can take anywhere between 2-5 months or so.

Flying to Seattle on 6 May 2014!

Once your fiancee arrives here in the USA and you two are married (within 90 days) she will file for Adjustment of Status - this will get her a green card. So, nope, no reason at all for her to leave, in fact it would be very bad if she did leave before getting her status adjusted. ;)
