Is it too late now?

Hi everybody, my husband and I got married in his home country on 07/31/13 I returned to the USA a couple of weeks ago and now we are getting ready to send the I-130 application package. Meanwhile, I read all these horrible posts on VJ forum lately about ppl having to wait for over a year for an I-130 approval...these stories really scare me because obviously I don't want to be separated for such a long period of time...now I'm thinking IS IT TOO LATE to apply for a tourist visa and then file for AOS? cray5ol.gif

I know you must be thinking "why didn't you check your facts sooner" but honestly I did PLENTY of reading on VJ and USCIS before deciding to get married but then everything seemed to be running smoothly and processing times were 6-11 months for a CR-1 VISA. ANY help would be greatly appreciated...!

I am a bit confused on your post. If your husband wants to apply for a tourist visa to come to the states to then do AOS is visa fraud and he'll have very rough times, if not get turned around and banned. I believe that is worse than a waiting period of one year for the I-130 to be approved. AOS would've worked if he came here to the US with his tourist visa, and without any intention, but you guys would've realized that you guys don't want to be separated anymore, and get married. Then he could have done AOS. But this other way around he will probably not even be able to get a tourist visa now as he is already married to you thus showing "immigration intent". So, I think go with the longer route, and if you two truly love each other, time cannot stand in your way and shake your love! I wish him (and you) all the best!

Ok guys, thanks for your help.... I wish I had known about the drastic increase in processing times before getting married...:(

Hey cheer up! Many people went your way, and they all survived it, and made it. You can still go and visit him in Serbia in the meantime just fine. Do not let time to kill your love. You can go see him, and you guys can chat on skype, and send each other small packages etc. These will make time feel go faster, and plus will create memories that you guys will look back and smile and say "Darn! It was worth it, and was awesome how we chatted over skype, or when you sent this mail, or that mail...etc." If you guys love each other this processing time will be nothing! Good luck and never give up faith!

Thanks for your reply and encouraging words, Lost Soul, I know your right, half of our 3 year long relationship was long distance....so I know we can do it it's just that I'm a little sick of it...but we're gonna get through it you are right...best of wishes to you and your spouse too :)

That's the sprit, Husakovic! :) If you guys were in long distance for 3 years this will be a breeze! Just hang on! Have strength, faith and patience. In no time will you be with your spouse holding hands! :) Will be happy to hear the progress on your application! :)
