Interview not until february due to reschedule - apply for new AP?

Hello,

So I probably won't have my GC interview until February according to the nice lady at USCIS (our original date was in August but we had to reschedule). The things is, my Advance Parole was accepted by the end of May 2013 and I intend to travel home next summer as well - can I renew my AP while we wait for their decision?

Because I've heard that the NYC office takes forever even after the interview to give out the green card.

March 2008 - Met my husband (US Citizen)

10/10/2012 - Arrived to the US on M-1 Visa

01/13/2013 - Husband arrives to the US

03/15/2013 - Got married in NYC City Hall!Received marriage license on the same day.

03/30/2013 (Day 0) - Sent in I-130, I-485, I-765 and I-131

04/03/2013 (Day 4) - Package received in Chicago

04/10/2013 (Day 11) - NOA 1 text(s) and emails received.

04/15/2013 (Day 16) - Biometrics appointment letter for the 7th of May 2013.

04/22/2013 (Day 23) - Successful Biometrics walkin Varick Street, NY

04/30/2013 (Day 31) - I-485 case status updated to testing and interviewing. Still no updates on EAD or AP

05/07/2013 (Day 38) - Biometrics appointment

06/07/2013 (Day 69) - EAD updated to Card production. AP updated to Post Decision Activity.

06/15/2013 (Day 77) Recieved EAD/AP combo card

07/10/2013 (Day 102) Received first interview appointment
08/10/2013 (Day 132) Interview (which we rescheduled because I was out of the country at the time of the interview)

08/24/2013 (Day 146) Notification that our interview has been successfully rescheduled

11/25/2013 (Day 239) New Interview date: 16th of December 2013

12/16/2013 (Day 260) INTERVIEW! - Approved on the spot, will have green card within a few months

Yes, you can renew the AP or if the interview results are good then you can make an INFOpass appointment to get the GC stamp in your passport. I would like to think that the GC would arrive before you need to travel next summer. That's 4 months from the interview to June. Once approved our GC arrived 3 days later. Let us hope by slow you mean 1 to 2 months and not 4. Whatever you do, make sure you leave yourself enough time to receive the proper documentation by the time you plan to travel.

USCIS recommends that you renew an EAD and / or AP 120 days before your current documents expire.

You can renew by completing a new application, enclosing a copy of the NOA for your I-485 and a copy of your current EAD or AP.

I do want to add, that for 95 % of the times people get their green card within two weeks from the interview date (if approved). That sort of means if you don't reschedule your February interview, and go there and get approved you'll have your green card in about two weeks. So you'd have your green card by summer easily. But of course, if you rather renew your AP because you feel better that way, as others said, yes you can do it. Good luck and all the best!

Hey, thanks guys.

I've heard unfortunately that the incompetence at the New York office is heavy and that people have had to wait up to 70 days AFTER interview to even get an approval notice (even if they got approved spot on). Also, I don't know if my interview will be in February, that's what they told me in the info pass, that it "ish" takes around 5 months to reschedule so I'd PROBABLY get mine in February.

Now, I don't mind the wait, I'm a student and have busy days up until June next year and also have the EAD and AP if i wanna work or travel, and I can't see why we wouldn't be approved, I'm just getting slightly worried/annoyed with the fact that it all might take over a year and that I'll have to renew the AP, the EAD and even the medical thingy I had to do....

You won't have to redo the medical, provided you (i) submitted it alongside your I-485's initial submission, and (ii) there are no class A or B medical conditions noted on the form, other than a class B condition noted under "other medical conditions". In this circumstance the I-693 will remain valid for as long as it takes USCIS to adjudicate the application.

I am in similar situation, prob even worse since I still dont know when is my interview date and it has been over 120 days since my application date (I applied on Jul 1th).. I received my EAD in the beginning of Sept and have not heard anything about my interview, the local office informed the current processing time for this type of case is 5.5 month..so I am prepared that I am not going to get my approval this year, and will see if I have to renew my EAD next year. I want to travel back to visit parents who I have not seen for 3 years however I do not dare to leave US while my case is still pending even if I already have AP. So, just have to keep waiting! if there is any helpful advice on our case..will be very appreciated!
