All,

We are in great confusion about our situation and thought our fellow VJ'ers can help us. My fiance's visa got delayed due to passport photo not being latest. So, if he comes here by Dec 1st 2013 and we apply for I-765 (EAD) and I-131(Advance Payroll), we need to visit India in March 8th for a family function. The other option is to stay back in India till March. But fiance visa if we dont go to port of entry can create problems correct?

If we apply in Dec, does it create a problem for getting Advance Payroll in March? How long does it take for it? Please help!!

Timeline

You have until the expiration date on your K-1 visa to use it, which is typically 6 months from your medical. Once he arrives, you marry and when you get your certified marriage certificate back from the court, then you can apply for AOS. You could have all the paperwork ready to go which will save you time. It takes 2-3 months from filing for AOS to receive the EAD and Advance Parole.
