NOA2 Hard Copy Rec'd - Questions

Hi

So, we rec'd our NOA2 hard copy yesterday, but i'm not sure i understand it fully, so have a couple of questions that i'm hoping you can help me with.

Firstly, i don't have a copy, my fiance has it and he read it out to me, so i'm sorry if i haven't used the exact words or phrases

Q1 - One of the first lines says that our case has been sent straight to the 'listed;' consulate, but i thought it had to go to NVC first, or does it go to both at the same time?

A paragraph further down the letter says that it has gone to NVC and the 'listed' consulate

Q2 - What is the 'listed' consulate? Does that mean the consulate in the country I am in? (England). They don't name the consulate in the letter and they waffle on about if your case has gone to the wrong consulate you have to do this,...and that...etc

Q3 - At the top of the letter it says our case is in a ...ummm...timeline/date (sorry can't remember the words exactly)....from Oct 30th 2013 to Feb 28th 2014. Does that mean i have to have had my interview by that date?

Q3 - After browsing this forum i've heard rumours of NVC taking 8 weeks to process applications and also a 2 month backlog of interview dates at the Embassy in London. If this is true, we are going to be hard pressed to get our interview in the timeline processed. So what happens if i have not had my interview by that date?

There are also no instructions in the letter on what to do next.

I have found that their emails and letters are very disjointed and difficult to follow, in fact, quite unprofessional in some cases.

After approval, your case will forwarded to NVC for processing (see my timeline on signature). After a while NVC will forwarded to consulate. Wait a few weeks before call NVC or DoS and asking your case number. With your case number, you'll able to check your visa application status on CEAC.

Q2 - What is the 'listed' consulate? Does that mean the consulate in the country I am in? (England). They don't name the consulate in the letter and they waffle on about if your case has gone to the wrong consulate you have to do this,...and that...etc.

On your I-129F, almost bottom of page, the petitioner wrote which consulate your fiance will apply for visa. Ask your fiance about that or check copy of your I-129F.

NOA-2 is valid up 4 months and consulate will extended it automatically if you're showing to them intend to pursue your K-1 visa. You have to prepare all papers within that times. If you have interview after your NOA-2 expired and you already sent all papers to consulate, they will extended the validation of your NOA-2.

I have no idea about US embassy in London. If your I-129F was processing at TSC they were pretty fast sent to NVC after approval. I've got my case number from NVC less than 2 weeks. Keep make a call. No harm to try.

Timeline

The NOA2 expiry date can be extended by the Consulate. I believe for London, if the interview is scheduled after the 4 month expiry date, the beneficiary needs to bring a new notarized letter of intent from the US petitioner to the interview to revalidate the petition.

It's taken us 5 and a half months to get to this point, so i do have one more question

I've just been reading up on what the Consulate will need

One of the items states is 2 2insx2ins photos that were taken within 6 months of the interview date, so it now seems that my original photos that were submitted with our application will be invalid.

If i send them different photos to the originals, will they question that?

It won't be an issue at all. I am going to have my new passport photos though the previous one is only 2 months old. The reason why because I changed my hair colour, content.gif .

The first photos were for the petition. The second set are for the visa. It's two processes with two separate government agencies. The first aren't "invalid" really, they were part of a different application (I-129F). Now you will need 2 more for the visa and 1 for the medical. Then you will need 6 more when you do the adjustment of status applications. Also they are not "sent" (mailed) to the embassy. They go in hand to the interview in London. Each consulate does it differently so make sure you learn the London plan.

To summarize your earlier question. The case will go to NVC, then London. If you can't get the visa accomplished by the 4 month expiration of the petition, you will provide a notarized letter of intent from the US fiancé at your interview in London to revalidate the petition.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
