Specific Questions on I-130, I-485, I-765

Hello everyone,

We are just going through the task of filling out all our documents for our I-130, I-485 etc and I had some specific questions partly because I am a completely, paranoid person. Any help with this would be amazing!

I-130:

Do I use my maiden name of my married name - I haven't changed my name on passports, IDs etc yet... I am the alien spouse.

I-485:

Part One:

  • I put my USA address here yes?
  • Current USCIS status - I am here on an ESTA tourist VISA ? What do I put here? I travelled here in August and my boyfriend proposed when I got here - so I didn't travel here with intent.

Part Two:

  • h? Is it enough to say I travelled here as a tourist without intent to marry? Or do I need to go into more detail here? How do I do that if yes?

Part Three:

  • Name on i94 - Do I leave this empty?
  • Should I put information of my expired USA VISA here or is this just for current VISAs (I was a student on an F1 but my OPT status expired in Dec 2012)

I-765:

Do I use my maiden name of my married name?

I-131:

Part 1:

  • 2a) In care of name? What does that mean?
  • 3) Alien registration number - I don't have one yet? Do I just leave this blank?
  • 6) What is my Class of Admission?

Part 2:

  • Is 1 a correct even though I am change of status stage?

Part 5:

Do I compete this section?

I-864

Part 6:

13 c - My husband's income was below the poverty line 3 years ago - the last two tax returns are way above the line - will this be a problem?

You use your current name. So if you changed your name during marriage, this would be the new one.

I-485:

Part One:

  • I put my USA address here yes? yes
  • Current USCIS status - I am here on an ESTA tourist VISA ? What do I put here? I travelled here in August and my boyfriend proposed when I got here - so I didn't travel here with intent. That or "visa waiver tourist" should be fine.

Part Two:

  • h? Is it enough to say I travelled here as a tourist without intent to marry? Or do I need to go into more detail here? How do I do that if yes? No. A.

Part Three:

  • Name on i94 - Do I leave this empty? Well, visa waiver people used to get I-94W's. Now they automate the I-94s and people don't get paper ones. You print out the I-94 from the website. I assume the same applies for I-94W's. (not sure)
  • Should I put information of my expired USA VISA here or is this just for current VISAs (I was a student on an F1 but my OPT status expired in Dec 2012) Nope. Your last entry was not on a visa.

I-765:

Do I use my maiden name of my married name? Married name

I-131:

Part 1:

  • 2a) In care of name? What does that mean? Most people don't use this. This is for if you want to use someone else's address and they take your mail for you.
  • 3) Alien registration number - I don't have one yet? Do I just leave this blank? just put "none"
  • 6) What is my Class of Admission? I think it would be on your I-94W and also on the stamp in your passport.

Part 2:

  • Is 1 a correct even though I am change of status stage? NO. 1.d. You are applying for Advance Parole.

Part 5:

Do I compete this section? No. You are applying for Advance Parole. You skip from Part 3 item 3 to Part 7.

I-864

Part 6:

13 c - My husband's income was below the poverty line 3 years ago - the last two tax returns are way above the line - will this be a problem?

No. Past tax returns don't have anything to do with the poverty line. The only thing that has to do with 125% poverly line is current income.

Adding just a bit to your good answers. If you want the greencard in your new married name, then use that on every application. It doesn't matter of you haven't changed any other ID.

ESTA Is not a visa. Your arrival was VWP or visa waiver. It means no visa was required.

Name on I-94? You don't get an I-94 unless you enter on a visa. I also don't know if you can retrieve your I-94W information. Don't think so with the online I-94 thing. But your name in the record would have been taken exactly from your passport, which is also the name you would have used for the ESTA clearance process to be allowed to travel visa free.

Someone said on here that VWP I-94Ws are available now online in the new system. You put in "WT" in visa type.

We got married on Saturday (yey!) and I am just getting the rest of my injections done etc etc. My question is, my tourist visa runs out tomorrow, we nearly have everything together for the i-130 but my last injections are tomorrow afternoon. Do I need to get this application for i-130 and i485 out with the date stamp tomorrow? We are collecting out marriage licenses today, we have passport pictures and pictures and bank accounts etc all good to go. I don't want to annoy them, but it may be a stressful 24 hours if it needs to be out tomorrow...

If you don't get it out tomorrow, don't worry. Any overstay is forgiven on marriage to a USC.

Okay thanks for the advice. We are planning to get it out as soon as possible, so definitely before the weekend. Hoping to get all of it processed as quickly as possible. I see yours took 3 months ish to get through?

It was about 3 months from mailing in to GC approval :) It seems to depend on how busy your local office is. I'm in MN, and it went through a bit quicker than places like Tampa where they are backed up.

Ah that is wonderful. We are in Reno, NV so I think it will go through either Arizona or California eventually. Hopefully it is just a quick....

Last question:

I had my medical done last week so they used my maiden name - do i need to have them refill out the paper work with my marriage name? I go to get it tomorrow once I have had my TB test checked and then my final injections.... ugh hate needles.

I don't think you'd need to. They are used to peoples documents having both maiden and married names.

Last last question: For Part 7 on the I-131 do I need to put an extra piece of paper explaining my Advance Parole?

I already put for work and family related reasons, specifically a 93 year old, sick Grandma....
