If she wants to apply on her own once the two years are done and you are divorced, then she will have to prove that the marriage was entered in good faith; the burden of proof will be more heavily weighed in order to prove a legitimate marriage. There is nothing you can do to stop her from filing when the time comes. I am very sorry for your situation but you should divorce her and try, as best as you can, to move on with your life. Whether or not she will get her 10 year greencard will be up to USCIS. Best wishes!

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

I find it interesting that the OP is asking about ROC in late 2012 and early 2013 when "he" states that he and his wife do not need to file until 2014. Also he has no taxes or any information about them living together. No wonder if now the story is she left him 30 days after getting the 2 year GC. At least the story remains mostly the same in each of these threads:

There are no joint accounts, no joint taxes filed and she has been living in CA while he has been living in GA. There is no evidence of a combined life what so ever. IMHO, this is one of the clearest cases of marriage for a GC I have heard of here on VJ and I hope the OP's "wife" get what she deserves.

I am beginning to think that "he" is the wife and now she realizes that ROC is coming up and they need evidence of a bona fide marriage or she is screwed and cannot get the 10 year GC. My advice remains the same in that he should divorce her and let her deal with her immigration and let USCIS make the determination of whether she qualifies for a 10 year GC or should be deported.

yes i marry a philippines woman we got to file to removing her conditions on her green card in 7 month but she came here in 2012 after she got her 2 year green then she move 30 day after to california she want pick up the phone or nothing all she care about money and she want a divorce i know this marriage is not in good faith all she want a green card the questions is do she need a proof that she marriage me in good faith after we get a divorce and can she marriage someone new and still get her a 10 year green i know it a scam do she still need proof

I'd have to agree your English is poor for an American or you need to learn how to type I know we all make mistakes but yours actually read like a non a English speaker. I'm from the UK and my fiancée is the American citizen. I deep down think this is the scammer and if it is you should be ashamed of yourself because it's things like this that make us look bad. So I refuse to help and I hope she gets deported back to where ever she's from.

I agree with you about too many Filipino's girls do this. I am the one who almost broke up with my fiance because one Filipino's girl came to my fiance house then she slept with my fiance and she told she is a virgin so my fiance have to take care of her even he said he can't do this becase he has me to be his fiance but she didn't care and she said I am not in US. I really negative about alot of girls from this country do.

I can not imagine for a second that this is an educated American male that posted this. I agree with the others that this post is a plant just to see if they can get a rise out of the group. This person could not have filed for a visa! I also recognize this style of writing as being Filipino. "..she marriage me in good faith.." ??? Who the hell says that as an educated English student?

Multiple questions about removing conditions a year prior to having to be done. Non-native English, which could be a naturalized citizen. (hubby has been here five years and still writes poorly but he is a citizen).

The question has been answered multiple times and the OP seems erratic in returning to respond.

If this is the US spouse he needs to just move on. Nothing he can do since she has the two year green card.

If this is the immigrant spouse, she needs to file for ROC on her own and hope for the best. Need loads of evidence of a joint marriage, not just the relationship or the wedding. You need leases, joint bank accounts, joint credit cards, insurance, etc. A lot of people filing for AOS receive request for evidence because they did not provide enough proof of the ongoing relationship. Note the word-ongoing-not just came here and got married.

Unless the OP returns nothing left to say.
