Hello,

We are in the middle of AOS and received a RFE for the I-864, however we sent all that information along with our AOS application, I think the problem is that it wasn't enough.

The Sponsor is a student who has only filed taxes this year for last year. They have never had to file before. We live off student loan monies because the sponsor is only a student and doesn't have a job.

Has any one been in this situation?

How do you prove that a sponsor has enough money to support the beneficiary without a job simply the sponsors student loans, If that is the only money they live off?

What documents can be submitted to communicate to USCIS what is going on?

We had sent proof of loan dispensements but guess that is not enough since we got the RFE.

On the RFE it indicates we can submit a letter of why the sponsor was not legally obliged to file taxes, don't know how that will help!

Student loans don't count towards meeting the minimun requirements for the Affidavit of Support - they are debts, not assets. In this case, you'll need to get a co-sponsor who has sufficient income to meet the requirements of the I-864.

WHAT TO DO...HELP!!!!!!!

Why question the obvious? If USCIS wishes for you to explain the reason the sponsor had no tax return obligation, why not do so? Indicate that the sponsor's income fell below the income level required for a tax return, and accompany that statement with an excerpt from the IRS tax code, that shows that the sponsor's income came with no tax payment or return obligation.

You need a co-sponsor. My husband graduated this year as well, and just filed taxes for the first time this year, and thus we're using his dad as a co-sponsor.

You will require a letter from the IRS indicating that you were not required to file taxes for the past 3 years. Contact the IRS and explain the situation and see if they can help you out.

Everyone who doesn't file taxes needs to provide proof of why not as part of their application.

You only need to send one tax form in (unless you want to send 3), but they ask you for the ammount declared on taxes for the past 3 years.

We wrote an attachment explaining that my husband was a dependant of his dad for the past years (as shown in his dad's tax, since he's the co-sponsor) and that's the reason we didn't include information on that. I hope they accept it and that we don't have to hunt down this doc from the IRS.
