Today we received noticed of action. Basically the I129F was approved and forwarded to the listed consulate (which, it doesn't list so, we have no idea where it went).

The letter then goes on, "The petitioner can also file form I 824, application for action on an approved application or petition to request that we notify another consulate of the petition approval for visa processing purpose. THIS FORM IS NOT A VISA AND MAY NOT BE USED IN PLACE OF A VISA"

It also gave us a date to be married by so, we are a little confused on what to do next. Te beneficiary is here on a visit (USA) for a vacation. When the beneficiary comes back, do we now inform customs about the notice, and she can get her passport stamped or? not?

The letter states something about applying for permanent residence as well, Its pretty confusing if you ask me. If something with some experience can chime in and give us a few words of our next step, it would be greatly appreciated!!

On an I-129F, almost at bottom page, there is a box that the petitioner filled in which consulate/embassy your fiance will apply for visa. Anyhow, congrats for approval.

Thank you for that! I hope he wrote one near by and not the one in montreal, that one is extremely far! I don't know which one he would've put.

Your petition will be forwarded to the NVC. After the NVC reviews it they will assign a Case Number and forward it onto your consulate. They know which one to send it to. Hope this helps!

I've just checked my I-129F approval letter (I-797). It is not the date of married. But, you have to marry your petitioner in 90 days after arrival in US. All information on I-797 is about what you have to do after you come to US. VJ community is such a big help. Good luck.

So with this letter, we are just waiting for interview dates i'm assuming?


I've just checked my I-129F approval letter (I-797). It is not the date of married. But, you have to marry your petitioner in 90 days after arrival in US. All information on I-797 is about what you have to do after you come to US. VJ community is such a big help. Good luck.

Well I am currently in the US for a visit, can we technically get started on our marriage licences now?

Your I-129F was processing at TSC like mine. TSC is pretty quick sent the case to NVC. I've got mine a week after my fiance (the petitioner) received I-797 by mail. I guess, you probably need start call NVC and DoS to get your case number. With the case number. you can check your visa application on CEAC. Please, if you have a time you can read this post.

I'll give that a check. Basically now, once I get all that, interviews begin, medical/police checks, all the fun stuff now and hefty fees!

It's unfortunate when you find true love you have to go through all this only because people decided it would be fun to scam the govt.

The best part of all this is, I just found out I'm pregnant. I would love for this process to quickly speed up so we can be together before the baby comes!

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Besides Montreal, Vancouver is the other one. The other Consulates don't process these visas, which sucks I know. Winnipeg would be closer for me but from what I read, it will be Montreal.

10/28/13-I-130 Sent via USPS to Chicago Lock Box from Abroad

11/01/13-I-130 received at facility

11/12/13-Contacted Chicago Lock box to find info on our petition and was told it is being returned.

11/14/13-Received package back from Lock Box with RFE to resend it with correct filing fee.

(Money Order not drawn on US account)

11/25/13-I-130 Sent via USPS to Chicago Lock Box from Abroad with correct method of payment.

12/06/13-Received NOA1 via Email stating our case has been transferred to Nebraska Service Center.

12/12/13-Checked USCIS site for Case Status. Seen our case is in initial Review.

12/16/13-Received Hardcopy NOA1 in mail.

Feb 5-crossed border to US to see hubs and son off at airport. Flew to CA to establish domicile.

Feb 11-Case touched to update hub's change of address

Unfortunately, the options are Montreal or Vancouver and USCIS picks which one you go to (depending on where you live in the country.)

If you are on a K1 - the next steps are to wait (but to prepare for) receiving your Packet 3 from the Consulate. You will have more forms to fill out, order a long-form birth certificate, a police report and take more passport photos.

After you send it you Packet 3, you wait for them to approve that.

When you receive Packet 4 (typically in an e-mail, if you've provided one) - THEN you can schedule your interview (and your medical).

I wouldn't start with marriage licences... you still have another 2-6 months ahead of you at this point. The consulate is scheduling interviews into March at this point. If all goes smoothly/quickly for your NVC, Packet 3, Packet 4 experience - I'd guestimate an interview in May-ish for you.
