Am I married or still single in the US (weird question)

When filing taxes, unless your husband have been in the US for 6 months, you file head of household if possible. You are considered legally married but because he haven't been in the country you file head of household. Trust me i know this info firsthand. Btw...please register your marriage in the US..you dont want any problems down the line

You need to have a qualifying dependent living with you in order to be Head of Household.

Nowhere in my post did mention head of household!

There is NO official "registration" for a foreign marriage... Some states have the ability to file official documents but there is no need (or system) to do any type of registering of a foreign marriage... Married is married, your foreign marriage certificate is recognized here is the USA. No need to do anything else.

I live in the state of maryland and when i got married to my husband in jamaica i had to come home and take our marriage license from jamaica to the court house in maryland for registry

That is a strange requirement since the Maryland circuit courts say that foreign marriages are considered legal and do not need to be registered...

Example... http://www.mdcourts.gov/clerks/howard/faq.html as well I found that in 5 other Maryland district courts... If the USA federal law states that they are recognized, the state cannot say they are not...

On the Federal tax form (W-4) it says if spouse is non-resident then mark "Single"

Now I'm confused ???

Thats what it says:

Note.
If married, but legally separated, or spouse is a nonresident alien, check the “Single” box.

That's for them to remove taxes from your pay, not for how you would FILE your taxes.

Your I4 just tells how much money in taxes gets deducted... You can file 0 or single to have more money deducted or 3,4,5 to have less taken out each pay heck.. But filing federal taxes you must mark married...

I had this confusion myself. We were married in the US but we haven't reported our marriage to the Phil Embassy so I wasn't sure if our marriage is recognized here in the Philippines.

Almost everyone I asked basically said that once you're married, you're considered as married anywhere else in the world. *high five*
