Request for More Evidence - K1 Visa Accra

I have been quietly following this site for sometime while my fiancé and I prepared for our K1. I wanted to spring up a surprise on how helpful you have been, but as usual, every one who goes to the embassy in Accra is considered fraudulent. Just a summary of our journey below.

We have been together since 2009 (he was separated at the time). He has visited Ghana in 2009, 2010, 2012 and he's currently here. in 2011 when I was denied a B2 visa, His sister invited to London on vacation - where he proposed.

We filed in November 2012, got an RFE in June and was approved in July. Our interview in Accra was on October 30, and my fiancé came with me. At window 1, our documents were collected by a nice gentleman who kind of conducted his own version of an interview. He was so nice that, I really got relaxed before getting to the CO.

However, the CO was so rude (my opinion), I couldn't here most of his questions very well - so it later seemed I was contradicting myself. He seemed to have made up his mind before I got there, and after about 10mins, he said "I don't believe your relationship is genuine. Bring back more evidence on November 21st". I had three people go for K1 visa's before me, and they were all asked to come back with further evidence.

Some of the questions he asked were;

  • How did you meet (with counter questions. I wasn't able to finish answering before he asked another).
  • When did he immigrate to the US?
  • Who invited him (I wasn't too sure of this at the time).
  • Have you ever applied for a US visa? (yes)
  • Who invited you? (a family friend)
  • Has your fiancé been married before? (Yes).
  • Does he have a child? (Yes)
  • don't you have any other form of communication apart from phone? (No, we are always talking on phone).

Possible Red Flags:

  • I have been denied a B2 visa twice in one year
  • My fiancé is 16 years older than me (he doesn't look it though, and I don't care).

Documents we took along;

  • A ton of Call Records since 2009
  • Copies of boarding passes and passport stamps.
  • A few pictures ( am no a fan of pics, and most of those we have greyed out)
  • Affidavits from my mother and his cousin through whom we met

My fiancé has changed his travel plans to stay and go back with me for the second interview. We are both confused as to what more evidence they need. Maybe my nervousness killed it, but isn't it normal? I can't forge any documents, what I have is what I took to them. Should I take the same things back, and maybe more pics of us now that he is here? They held on to our pictures, but gave the other evidence back. When the CO asked for our London pics, he took them to the back for a while before returning. It was also evident that he was talking to some one behind the pillar every few mins - what does it mean.

What are our chances of being approved at the second interview? Your usual great advise will be appreciated. I am so tired.

First of all, I am very sorry about your experience. I think the red flag might be the age difference, your fiancé’s prior marriage, etc., but it’s not your fault.

I will recommend sending other evidence in the form of chats (Skype, Wassup logs, Facebook messages, etc.) to show that you guys have an on-going relationship. The CO may be able to determine if your conversations are truly romantic or not if you show them the chat logs. A variety from different periods will be enough.

When you go back later this month, include everything you send yesterday, and treat it as separate interview. In other words, don’t just submit new docs, and hold back on the prior ones. Also, submit everything when they ask for it.

In regards to affidavits, don’t put too much hope on them; although I will say send them anyway. In our case, we got affidavits from well-known people such as the Greater Accra Regional Police commander, the national PRO of the Ghana Police Service, CEO of Achimota hospital (all family friends, and even attended our wedding) but the CO never even bothered to read any of their affidavits. It was the chat logs that put us over that finish line.

Also try to highlight when you make/receive calls from one another so that it can facilitate a quicker review for the CO. It’s also best to include communication logs from you AND your fiancé, and not just from one person.

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

AM VERY SORRY for your situation. I believe all isnt lost yet. If i were to be the CO, i would have denied you the visa cos your evidence submitted was below par. From 2009 up to date has been that long for you to have evdence in abundance.

Neverhteless,the age difference isnt a red flag at all. My fiancee is 15 years old than me and that didnt feature in my interview. What i can tell is a sure bet for a red flag is the B2 visa denial twice in a year. The implication here is that since the B2 didnt work, you want to try other alternatives.

I would suggest that, whilst your fiance is around with you for the time being until your next interview, you should try and take more pictures. Pictures with only both of you is not advisable; take pics with friends and family members at different times and places. Moreover, if you have letters between the two of you add them and the envelopes with the stamps on them. Dont forget to add any cards sent to each other. Make sure to check your phone number on his phone records. Try and also go to your telecom network operator here in GH for your phone records for only your fiance's number.

As for the CO talking to someone behind the pillar in the course of your interview is normal> They do that all the time when they arent sure about something. When i had my interview, a CO from another window came to my CO interviewing me to show her some pics and letters and ask her some few things.

Thank you for this info jahk... I was very nervous myself about my fiance having trouble with being denied once in January for the b2. He of course, as many are, denied because of insufficient 'binding ties' and monetary support in Ghana. We did the b2 so he could see and experience America before sending him back to Ghana to start on the longer and more arduous process of the k1. Little did we know (weren't members of this site yet) those always get denied. He will answer this truthfully and hopefully it will work out for us...

I have been able to get some SMS snapshots from last year, but like I said earlier, I had call records from 2009 (highlighting his numbers). However, my fiancé could not get his call records, I hope that won't be a problem. I also remember the CO asking, "don't you have any other means of communication"?

I also read from the 221(g) form that, any additional evidence we bring should not have been created after our first interview. Won't it be a problem if I send in pictures we have taken within these few days? My fiancé's brother just gave us some pictures we took earlier this year with his family (but not dated), how do we prove they were taken a long time ago?

Should I also print and send the photos he took from us?

Does my prior B2 denials mean we should just forget this and prepare to reapply?

I also just realised that the petition expires before our second interview. . . . . my fiancé has sent them an email to enquire if its been extended.

Akua44, my fiancé went for his K-1 visa interview on October 28th, two days before you went for yours. He has also been denied B2 visa twice and is 14years older than me. That was not an issue. He was never even asked about his past 2 B-2 visa denials. If you have a Facebook account with pictures and comments of both of you and friends, you can add it. I would also suggest you add your engagement ring receipt (If it is available). I'm sure from 2009 to date he might have send you something through the mail, if you still have the stamped envelops, add them as well. I advice that your fiancé try to get some his call records from his end as well. well. Just take more pictures (you both with friends/family at different places) while both of you are in Ghana now and add those given to you by your brother-in-law (there's not way to prove when they taken). When asked, just be bold and tell them that there were taken before your first interview date. Add any e-mail conversations that you both have. If you have any money wire transfer document/receipts showing that he has wired money to you before, you can add them as well. Remember all the answer you provided for the first interview, they might want to test you on the consistence of your answers as well. Be honest and confident in yourself and your relationship. First the prior poster was very very wrong to advise you to lie about anything to the consulate. That could lead to a lifetime ban. Only use pictures before the interview.Most cameras date photos even if they don't post it to the picture and you can be tripped up.

Gather everything you can think of go over it to see what you haven't shown yet, Ask friends if they took pictures that you don't have, Look though mail and chat records.

This will not be over quickly. You will not enjoy this.

When asked, just be bold and tell them that there were taken before your first interview date. Add any e-mail conversations that you both have. If you have any money wire transfer document/receipts showing that he has wired money to you before, you can add them as well. Remember all the answer you provided for the first interview, they might want to test you on the consistence of your answers as well. Be honest and confident in yourself and your relationship. OP, this is the worst advice anyone can ever give, NEVER, NEVER. NEVER lie to a Consular Official at an interview and NEVER, NEVER, NEVER fabricate evidence to present to a Consular Official or any other US Government official; period, full-stop.

Doing one, the other, or both will result in a permanent ban from the US with no possibility for a waiver.

Tell the truth and provide truthful evidence.

We did the b2 so he could see and experience America before sending him back to Ghana to start on the longer and more arduous process of the k1. Little did we know (weren't members of this site yet) those always get denied. He will answer this truthfully and hopefully it will work out for us...

U are most welcome. I believe all will go well for you. Having gone through mine without any flaws is the same thing i wished for every VJ member. All that we are all fighting and yearning for is to be with our loved and dear ones. It is well.

I am sorry to hear that you were hit with RFE. I just returned from Ghana on the 10th of November and I was there mostly to take my fiancee to K-1 to the interview. She had been refused B2 visa twice and both of us had been "married" before but during the interview none of the questions concerned her previous B2 refusals or our previous marriages. It never came up. The interview took less than 20 minutes and I sincerely believed it had to do with the tones of documents I submitted and the fact that I took charge of the process. Anytime she was called, I was in front unless I was told they only needed her. When she was first called to submit all the documents she brought, I handed them over. I overwhelmed the lady with so many documents that she gave us back some of those I thought they would need during the interview including my tax returns for the past four years, employment letter, my properties here and in Ghana and even the telephone bills. Her reason was that these documents had only my name but I immediately interjected that it was because we were yet to be married. She looked at my face and started to laugh. This was a Ghanaian lady. When she was called again to go and pay her visa fee, I was at the cashier's window paying it. During the figure print, I was there with her and finally at the interview window. During the interview, the CO asked me if I was the petitioner and I said yes and she politely told me to return to my seat and she would call me later. My fiancee was asked only four questions and when I was called to join her, I was also asked two simple questions like how we met and what are our plans in the US.

The long story short is that since your fiance is in Ghana, let him take charge of the process and overwhelmed them with documents especially personal and intimate ones. No document is irrelevant. Let them make that decision as to which is relevant and which is not. I had over 300 pages of skype conversations, about 100 pages of whatsup, several emails and greeting cards and public display of affection pictures. Feel relax during the interview and answer the questions with ease. Don't make it look as rehearsed.

Bear in mind that you can't produce any evidence after your first interview. Good luck

I personally don't think adding receipts for money wired is good idea.

in case u didn't, give all your evidence to the first person inside who asks for your documents .

u said u couldnt answer all questions, discuss your history etc to equip yourself with any info that may be asked of.

when u walk to interview together and your partner is asked to sit, show some affection before he leaves, like a peg or short kiss, let the love show in your smile to each other and your faces. just the way your friends see u together and see u r in love. it should be like something u do all the time.

very important, be confident and look CO in face. when u answer questions, sound like u know what u talking about, not tutupaapasu, I can imagine how u were sounding and answering questions since u said u couldn't hear him well and was contradicting yourself . not convincing for CO kraa.

also, before interview starts, ask CO if he can give u a minute to say something, if he says OK/yes, tell him how u and your mean to each other, how shattered u have been since your first interview. remember u have about 40sec because he'll likely cut u off.

then u proceed to questioning.

if u don't hear what he's saying, politely ask him to repeat and speak clearly, don't assume u heard him. it may go against u, u might not be answering his question if u thought u heard isn't what he said.

the B2 denial isn't an issue, I was denied B2 twice too.

get the pictures you talked about, write the month and year, place and people in it behind it.

any pictures any friend or relative has, get them, print and write the info behind. u said u only talk on phone so u need any form of evidence u can think of. for me, knowing I was in this process, I was making evidence over the period.

do fast and pray for God's favor, I wish u the best.
