Timeline

Hello,

Apologies if am posting in a wrong category / forum i wasn't sure where this should be posted.

I am the USC and am domiciled in IL, Chicago parents are also living here.

my husband when he gets the CR1, plan to POE at Chicago ORD.All our immigration forms have our chicago address as permanent address, where we will reside(parents).

Question, when he gets the green card and files taxes( we are both abroad and will be likely here for a year or so atleast before wrapping up) what state is he resident of? We are both not residing in IL except 2-3 weeks a year.

Secondly, I know IRS grants Foreign Tax credit upto 95K per person, double if filing jointly.does this also count towards state tax?

How can we go about change the tax residency to a no income tax state like TX, legally i mean we are not gonna try to evade.We intend to move our domiciliary state to TX as it might be better for his job to when he moves back here.

I know we may need to check with a tax consultant most likely, but would appreciate any helpful info members here may have.

its likely people here on this forum have encountered something similar before.

Because in our situation after he gets the GC, we are still not immediately gonna relocate, till he can sort out his work here.But we will still have to file taxes.

Also i have never filed taxes, was never employed since being a full time student(2010) and currently am a house wife.
