Hi everybody ,

I am currently pursuing a 4 year BA from a state university .

I recently started my 3rd year . I am on an F -1 visa .

Me and my girfriend ( who is a US citizen ) are planning to marry soon .

What is the process that needs to be done ? ( in terms of paperwork etc ...)

The goal is to become a permanent resident of the US so I could live with my girlfriend ( future wife ) ...

Will I need to leave the USA or will I still be able to continue my studies ?

Marry first, then file both packets I-130 and I-485. After filing, you do not have to leave the USA; and, in fact, you shouldn't leave until you get the Advance Parole papers after 2-3 months.

This all assumes you were not dating your gal before you came to USA and you two had not intended to get married even before you came to USA.

10 YEAR GREEN CARD PROCESS

July 22, 2017  ROC packet sent to Vermont.

July 24, 2017  ROC packet signed for in Vermont.

August 8, 2017  NOA received at house.  15 days since ROC signed for in VSC.

August 12, 2017 ASC appointment received. 19 days since ROC in VSC.

August 25, 2017 BIO completed. 32 days since ROC received in VSC.

August 11, 2018  18 month 'Courtesy Copy' extension letter received.  Critical number  297

October 20, 2018 18 month 'Official' extension letter received.  Critical number 297

December 4, 2018  USCIS Account shows: We approved your Form I-751, Petition to Remove Conditions on Residence, 

December 4, 2018, ordered your new card for Receipt # EAC17297003XX, and will mail to the address you gave.

491 days from NOA issued by VSC until Petition approved.

December 7, 2018 USCIS sent notice:  Card mailed.

December 12, 2018 Ten year Green Card received from Lees Summit, MO

499 days from NOA issued by VSC until Green Card received.

CITIZENSHIP PROCESS

December 6, 2018 submitted N-400 application on-line.  Estimated Completion Time: 8 months or August 2019.

December 8, 2018 received notice on USCIS that Biometrics scheduled . . . but the actual date was not yet shown.

December 11, 2018 saw in 'Documents' section of USCIS that Bio scheduled for 24 December 2018.

December 21, 2018 saw on USCIS website that they will be closed 24 December 2018 as extra holiday.

January 9, 2019 went for re-scheduled BIO appointment.  33 days after N-400 submitted on-line.

February 19, 2019 received letter in US mail that Citizenship interview scheduled for 26 March 2019. 74 days after submission on-line.

March 26, 2019 Citizenship interview scheduled for.  109 days after N-400 submitted on-line.

March 26, 2019 Passed Citizenship interview.

April 12, 2019  Received notice that Oath Ceremony had been scheduled for 24 April 2019.  17 days after interview.

April 24, 2019  Oath Ceremony completed.  29 days after interview.     139 days after N-400 submitted on-line.

April 25, 2019  USA Passport Application submitted.

May 3, 2019     USA Passport received.    149 days after N-400 submitted on-line.

May 9, 2019     Certificate of Naturalization and Citizenship returned in mail.

First get married. Then:

You fill out what is referred to as an I-130/I-485 package. The I-130 is a petition to be filled out by your USC spouse asking for permission for you to be able to adjust status based on your marriage. The I-485 is a form requesting your status be changed from F-1 student to permanent resident. These two forms are filed concurrently.

In addition to the I-130 and I-485, you can file an I-765 (Employment authorization while case pending) and an I-131 (advance parole - allows you to leave and return to the US while process is ongoing). These should all be filed concurrently. In the meantime, just be sure to keep your student status valid.

You will not need to leave the US. In fact, if you do leave the US after filing without an approved I-131 you'll likely be denied entry as F-1 visas does not allow for immigrant intent.

Yes, you can go to school.

Provided you have no negative factors and are otherwise eligible then AoS is usually approved as a matter of course.

(8) Evidence that your marriage was bona fide. This can include but is not limited to:

(i) Certified copies of birth certificates for children born to the alien and deceased US citizen spouse.
(ii) Evidence of co-mingling of finances (such as joint bank account statements, joint federal tax returns, joint life / health / property / vehicle insurance policies, etc.).
(iii) Copies of joint lease agreements / mortgages indicating shared property ownership or rental.
(iv) Any other documents indicating joint ownership or liabilities.
(v) Sworn affidavits from friends / family members that had personal knowledge of your marriage and can attest to its legitimacy.
(vi) Photographs of family members together (ideally the alien and US citizen spouse, but can also include children, gatherings, group events, etc. - often 15 - 20 photographs through the lifetime of the relationship will suffice).

A few more questions :

1) does the bona fida has to include ALL of those stuff or just photos and affidavits of 2 people will suffice ?

2) at what point are you interviewd ?

3 ) once you get the AoS approved it's valid for 2 years ? And then you need to remove the

" conditions " after 2 years ?

4 ) after 3 years can you get naturalized ? And if so what is the process ??
