This has probably been asked many times - but, is it better to pursue the I-130 (CR1) Visa

rather than waiting for the K3 to be approved, and - do you have to be physically living in the USA to pursue the I-130(CR1) because I only plan on moving there in July 2007. My I-130 just got approved yesterday. Please offer any advice.

My husband's I130 was approved last week, and I don't expect the process to be done any sooner than April or May. So in your case it probably does make sense to pursue the I130 as it is the superior visa. If you have no plans on coming down before July, then there is no real reason to continue to pursue the K3, unless as a safety net if something goes wrong with your I130.

Also - regarding the CR/IR1 distinction - I'm pretty sure that you have to be married for 2 years at the time you activate your visa - so if you have your interview at 1yr10months of marriage, but don't enter the U.S. until after your 2nd anniversary, you will still receive an IR1 as long as you make sure to confirm this at the POE.

No, visa is issued at the consulate. People who are in the US and want CR1/IR1 go back to their counties to get that immigrant visa.

last night, I just rec'd an email that our I-129F has been approved today....!!!

WOW.

Soo should I go for the CR1 visa, and abandon the K3?

Are there any pros and cons to both?

Also, Do I have to send them a notice to abandon the K3?

Many people in your situation continue to pursue both at this point - although I guess you'll have to see if your NOA2 for the I130 indicates that it is being forwarded to NVC or retained. If it is being retained and you do want to pursue the CR1 you will have to file the I824.

If your sole goal is to get your spouse to the U.S. as fast as possilble, K3 is still your best bet. Depending on if your interview will be in Vancouver or Montreal, the interview for K3 could be 2-4 months from now. After entering on K3 the average wait time for work authorization is about 3 months.

For the I130, the NVC processing may take 2 months, or much more (you never know). Then waiting time for Montreal for interview seems to be about 4 months. So that's looking at about 6 months from now if your I130 petition is actually forwarded to NVC immediately.

Thanks!! IT definitely helps, although I'm still not sure which way to go. I guess we'll wait to see if the I-130 has been retained or not....Like I mentioned before, I probably won't be moving to the US until June or July next year, however I am concerned about finding work sooner than later...so not sure which is better ....what would you do??

IR1 - married over 2 years at time of Visa activation.... you have to provide the appropriate proof at the POE...

CR1 - married under 2 years at time of visa activation.... have to apply to remove conditions between 90 days and the date of your 2 year anniversary of your visa activation...

if you come to the US with the K3 you can apply for AOS or you can go back to your country for the CR1/IR1 visa interview... but you have to let the appropriate people know that you are following through with the CR1 visa ...

I have a question about this. its a bit confusing. My Cr1 interview is about 1 monht ahead. exactly 1 year 3 days from the day we got married. So i will be getting CR1 i understand that but will I have to get IR1 2 years after the interview or 1 year since it has already been 1 year from the marriage? I am guessing from your writing its 2 years after probably but it doesnt sound fair. one can apply fo K3 which takes about 6-8 months to get, then go to the US act slow and get the interview date about after second anniversary and directly get IR1 , on other hand people who first got CR1 should wait 2 more years. its 2 years vs 3 years total. you know what i mean?

I dont really care for IR1 as long as i have some sort of visa that i can stay with my wife is fine but i was just curious because it sounded unfair.

you don't get the IR1 once you move to the US with a CR1 visa what you do is apply to remove the conditions on your green card, 2 years after your visa activation date not your marriage anniversary....

example:

Married March 6th, 2004...

Entered US with CR1 visa on April 2nd, 2005

Apply to remove conditions before April 2nd, 2007....
