Our I-485 has changed to testing and interview! This is good news. And we received this notification on the day I was supposed to have my biometrics appointment, so I highly recommend doing a walk-in for biometrics early - it saved us a lot of time.

my husband tried to do an early walkin for his biometrics on Varick St yesterday afternoon. They turned him away sad.png but they weren't nasty about, according to him. They said he could try to Brooklyn office today if he wants. He has decided to wait for his appointment next Thursday, Dec. 19.

10/2010 - met online, 12/2012 - reconnected, 7/3/ 2013 - my 1st trip to England & he proposed! 11/7/2013 - got married in NYC

I got an RFE for a birth certificate and a tax return for the last financial year. I gave the lawyer an original copy to send, maybe I gave them a photocopy with the I-485 originally...

Is it still possible to get another RFE for a joint-sponsor? We are above the minimum this year, but my husband didn't work last year, and so his income is $400 shy of the poverty guideline for the most recent tax return.

Does anyone know if the EAD and AP continue to be processed while an RFE response is under consideration?

I didnt know you should send an original birth certificate.

If he does not have a tax return for the last year, its good to explain in a letter as to why he didnt.

You shouldnt need a joint- sponsor but honestly i dont know. I have seen people complaining about uscis sending them random Rfes.

Thankfully we recently requested last year's tax transcript, so I had it available.

I was also under the impression the birth certificate could be a copy, too. The RFE says: "you submitted secondary evidence and/or a birth affidavit as proof of your birth record. However, the evidence you have submitted is insufficient..." Like I said, I sent them (via the attorney) my long-form New Zealand birth certificate. In fact, a second page tells me how to obtain the birth certificate that I have already provided. I gave the lawyer an extra original anyway.

Wow, you received your interview letter very soon! It shows we both filed on the same day, but all I got was an email on December 12 saying that my I-485 application changed to "Testing and Review"

I was wondering if the fact that I did not do a walk-in biometric would affect the timing of my AOS, but apparently it doesn't--at least it seems it is not a material advantage...

I went to my biometrics appointment on the scheduled day and it seems like my "Testing and Interview" notification arrived just 2 days after you received yours..
