The agent of support form is where I'm having the most trouble with. They (NVC) sent my husband a letter stating that his first step is to fill out the agent form DS-261 online otherwise nothing can be done yet, but Bosnia isn't a country on the list that does electronic processing. Is it just that the agent form is online now for everyone? I was copied in on the email and it states numerous times that he should go online and do it....can someone please advise.??

Please keep in mind, there's a HUGE difference between online forms and electronic processing (EP). Everyone is required to fill out online forms now, but EP is still only available to a few select countries.

Online forms = DS-261 and DS-260 filled out online

EP = emailing the AOS and IV packages

I am confused about passport clearance.

Do we don't require to submit Passport clearance any more? When do we have to submit it to NVC? In AOS or IV? When??

If your country requires passport clearance (like India, for example), then it goes in the IV package.

Just got yet another (this is going to be my 3rd) checklist from NVC.

This was issued on the day that DHL confirmed my IV package (reply to checklist #2) reached Portsmouth. Not sure what to make of it.

Looks like a false checklist based on them reviewing (and most likely accepting) the AOS package. Call up NVC to confirm.

I just received today a fake checklist (I called and they told to me disregard it), and I was wandering, if that is a good news, such as they are working on my case or nothing. Those of you who have gotten a fake checklist was your case finished shortly after you received it???

A false checklist just means they reviewed (and typically approved) that package. Has your other package been approved yet?

How long before the IV fee becomes available? I paid my AOS fee on Friday and I still don't have the IV fee listed. AOS still show processing . I know it said 2-3 business day but a check can clear the bank on the weekend so I don't see why thats a big deal.

The IV fee has NOTHING to do with the AOS fee. They're two separate tracks. The IV fee is only invoiced after the DS-261 is received and added to the case file. When did you complete the DS-261?

well, so far nothing has been approved, I have paid/ submitted everything. I submitted my AOS package beginning October, and beginning November received a checklist for leaving address field blank. Also, The IV package and the DS 260 form was submitted end of October. Could this finally mean that they re working on my stuff????????

If you received a false checklist, something must have been looked at. It'll say in the checklist something along the lines of "we received/reviewed so-and-so, blah blah blah". That thing they looked at is what is likely approved. Call up NVC and confirm.

this is what it says:

The NVC has received the requested Immigrant Visa Application (DS-230). However, we are still
waiting for the response to the checklist letter for the Affidavit of Support (Form I-864). Please return

When responding to the National Visa Center, please include the bar code sheet that came with this

I have a question about translation of documents. I know there have been some issues with people and the translation of official documents. Also it states on nvc that if the documents are in the language of the area where interview will take place then translation is not necessary. When we were married I visited the embassy to get some clarification on the procedure and also to meet the consular who will probably be handling our case, but anyway was told translations would not be needed. I called nvc today and they confirmed that we didn't need to have documents translated, documents are in french. I have overwhelmingly enough evidence that we don't need to have our documents translated, should I trust this? Any thoughts? Don't want to waste more time or money, want to file!

You are absolutely correct. I learned a couple of things tonight I thought I'd share. To answer my own question, the IV bill will show once DS-261 is entered onto my case file according to the NVC. Tonight, I also learned about the expedite process. If you guys know about it then please disregard but those that do not here's what I found out. I am requesting an Expedite due to my upcoming deployment and tonight was told about that process. Apparently, NVC only forwards it to the embassy of the country the beneficiary is immigrating from. Mine being Tegucigalpa, Honduras. Once they receive all the information which is:

Names of you and your spouse

Birth dates for both

Phone numbers. Mine and they required two local phone numbers for my wife in Honduras

Reason for why you are requesting and supporting documents. Mine is deployment and my supporting document is my notification letter signed by my commander.

Then it is up to the embassy to approve my request. I was told that if they approved it then I will deal strictly with the embassy and the IV package will be hand carried by my wife to the interview thus bypassing the NVC altogether (except for the fees of course but it can be paid at the embassy as well). If all goes well, they should let me know by next week if my expedite will be accepted and if it is then I can schedule an interview with the embassy to coincide with the time I am visiting for Christmas. Lastly, if the embassy approves our case then my wife will get her visa either the same day after 2:30pm or the next day. Wish me luck guys.

Yup, false checklist based on them reviewing (and likely accepting) your DS-260. Again, call up to confirm.

You can always try sending the IV package as is with no translations and see if they approve it. As you said, according to their website and such, translations shouldn't be required, but as I mentioned in the FAQ in post 2, I've still seen people get checklists asking for the documents to be translated. This doesn't happen all the time, but you never know. That's why I suggest translations. Plus, you may need the translations later on when you're in the US and need to show documents. But, this is all just my opinion.

Thanks Saylin. I had our marriage certificate translated to make it easier when I had my name changed. So the birth certificate and police certificate are what's left. I'm going to discuss it with my hubby and let him decide. We really don't want anything to delay us and keep us apart longer!!

Hi Saylin,

Just wanted to confirm one thing here, there was a detailed post earlier by you and lovewillprevail which says that "police clearance is required with packet IV"

But here you have mentioned that its passport clearance that goes with IV package.

Passport Clearance and Police Clearance are two different things here in India. Could you please confirm what exactly needs to be sent with IV.

emelieindgren- did you make your medical examination set up BEFORE you had your NVC case complete? According to the http://travel.state.gov/visa/immigrants/info/info_3744.html one should NOT get the medical examination done before having a interview day scheduled. So I am a little confused.

Also, does anybody know if we can call the embassy and try and see if we can set up an appoitment, or do we have to wait on NVC?

Thanks

Pls let me know when you get an interview date:) just waiting for the nvc to recieve my case, then I'm of to the sthlm embassy too, so I would love to know how long their wait time is. Getting a medical set up was a pain in the #### as there is one dr in sthlm, who's taking 3 weeks off over Christmas and new year,,

No you have to wait for the nvc, the embassy won't make an interview appointment.. I'm booking my medical for mid January as I'm expecting to at least av an interview date by then, otherwise the embassy told me it doesn't matter if I book it before I have a date set.. But since it was so difficult getting a time I'm happy I called them now, as the Embassy only gives you 4 weeks notice on the interview dates. And we are going to the states in the end of January and I want to be done with everything then so I can just fly home to the interview.

What is needed in the AOS package?

Generally, the following is needed:

With no joint sponsors:

- Bar-coded cover sheet from payment portal

- Cover letter (optional)

- Completed, signed, and dated I-864 form by petitioner

- Tax information* of petitioner (either just the last year OR the last 3 years)

- Employment letter of petitioner (optional, but good proof of CURRENT income)

- Pay stub(s) of petitioner (optional, but good proof of CURRENT income)

With joint sponsors:

- All of the above of the petitioner

- Completed, signed, and dated I-864 of joint sponsor

- Tax information* of joint sponsor (either just the last year OR the last 3 years)

- Proof of US citizenship/residency of joint sponsor (ex: copy of US passport, US birth certificate, US naturalization certificate, or front & back of green card)

- Employment letter of joint sponsor (optional, but good proof of CURRENT income)

- Pay stub(s) of joint sponsor (optional, but good proof of CURRENT income)

If the joint sponsor is a household/family member, also include proof of that relationship (example: if a parent is a joint sponsor, include the petitioner's birth certificate with parents' name on it to show link).

*You have two choices here of what to send in:

- Tax return transcripts ordered from IRS (preferred by NVC and of most consulates/embassies) RECOMMENDED

OR

- Tax returns (1040) and W2s and any other schedules (if applicable)

Hi, Could you please clear one more doubt here:

My father-in-law will sponsor me (as my wife is jobless), thus does he fall in the category of joint sponsor or Household member (as checklist for both are different)?

Do both my sponsor here (i.e. my father-in-law) and my spouse has to fill I-864? and then my spouse has to mention in the cover letter that we are having a joint/household sponsor?

Now , when my spouse is not sponsoring me, even then do we need to submit tax returns for my spouse also?

Then in the end, do we need to submit all these documents in a single packet (as USCIS website says that Verify that the petitioner has submitted an I-864 or I-864EZ. http://travel.state.gov/visa/immigrants/info/info_3202.html)?

Thanks

Please looks at DOS reciprocity table. For india, the police clearance is from Passport office. Hence the name Passport Clearance.

If you look at India forum, they you can get more details on getting a passport clearance.
