My boyfriend is a world renown Korean bboy. I will be going to the US in January (am an american citizen) and he is hoping to come with me at the same time. We would like to file for an O visa and have a large company to petition for him. If he has enough evidence, what are the chances he will be allowed to visa? We want to expedite the process by paying a special fee as well.. but don't want to.. obviously... waste money. What are the chances?

Did you read this : http://en.wikipedia.org/wiki/O_visa - especially the requirements part of it ?

Yes. What is the consultation opinion? This is the first time i've read about it. As for other requirements, he has enough evidence to support him.

  1. "Has performed services as a lead or starring participant in productions or events with distinguished reputations as shown by critical reviews, ads, publicity releases, publications, contract or endorsements;"

Has he talked to his Management Company? That would the obvious start.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Yes. But, it's my first time reading anything about a Consultation Opinion, what is that? As for requirements and evidence, he has sufficient evidence as follows:

"Has performed services as a lead or starring participant in productions or events with distinguished reputations as shown by critical reviews, ads, publicity releases, publications, contract or endorsements;"

-He has performed as a participant in 20 world competitions and has won 15, and about 7 can be proven publications.

"National or international recognition for achievements through critical reviews, other published materials by or about the beneficiary in major trade papers, trade journals, magazines, and so forth"

- Similar to stated above

- Team represents the capital city, kind of works for city hall.

"Has a record of major commercial or critically acclaimed success;"

- Has been in 20 plus commercials

Something his Management Company/ their Lawyers would handle.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Technically you do not need a Lawyer, but this is certainly an area where a Lawyer would be normal.

Especially as he will not be the one picking up the fees, that makes it a no brainer.

I see.

Sorry for all the questions, but what does this mean?

Consultation

A written advisory opinion from a peer group (including labor organizations) or a person designated by the group with expertise in the beneficiary’s area of ability.

If the O-1 petition is for an individual with extraordinary achievement in motion picture or television, the consultation must come from an appropriate labor union and a management organization with expertise in the beneficiary’s area of ability.

Exceptions to the Consultation Requirement:

If the petitioner can demonstrate that an appropriate peer group, including a labor organization, does not exist the decision will be based on the evidence of record.

A consultation may be waived for an alien with extraordinary ability in the field of arts if the alien seeks readmission to perform similar services within 2 years of the date of a previous consultation. Petitioners should submit a waiver request and a copy of the previous consultation with the petition.

Is there a labor organization for bboying?

You have just substantiated the need for a a Lawyer who is familiar with O Visa's, and who can put together an appropriates package. there are some that specialise. Mainly it seems in CA.

He doesn't have a management company, but the petitioning company is a non-profit organization that helps youths pursue the arts.

Sounds like he is coming to inspire kids, not to work in the US on his craft. Why not a B2 visa for a visit?

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!
