Enlighten me pls!! Income requirements!!

Hi Vj members! This is my first time to post a topic here. Im confused and dont know what to do. My fiance was working fulltime last year until May 2013, she was above the 125% poverty guidelines for 2 persons. But in June she started working part time because of her school, now shes planning to get a full time job again to meet the income requirements. Will it be ok if her income was less than the poverty guideline for 4 months? Dated june to october. But will start working next month full time and will make above the income needed. Were planning to schedule the interview in March 2014.

It's based off your fiance tax information and also the employer letter of employment. They calculate everything for the whole year. Why are you waiting so long to schedule the interview? Get in and get it done. You only have 4 months from NOA2 to interview, it's stated on the NOA2 hard copy.

In addition, if your fiance was working full time in 2013 he would have filled those taxes. As long as you get in before April 15th you should be able to use the 2013 tax information.

Hi Pooh and congrats on your NOA2! The COs will be looking for current income, i.e. your fiance's income at the time of the interview. The poverty guidelines are also an annual figure, so calculate her total income for 2013 and see if that reaches the 125% benchmark. Those 4 months of part time work may not have affected the total annual figure as much as you think. My fiance was out of work for a few months this year (not even part time!) and his total gross income for 2013 will still be over the 125% minimum.

Can he/she not extend the validity of the NOA2 by writing in to the Consulate/Embassy?

My Petition Expired – Can It Be Extended?

The I-129F petition is valid for four months from the date of approval by USCIS. A Consular Officer can extend the validity of the petition if it expires before visa processing is completed.

I think ours will be valid until February, were planning to ask the embassy for extension too, so she has time to work fulltime and we can show them that she meets the income requirements. If she starts full time next month, she'll be getting 24000k a year. Were counting on this because no co sponsor is available :(

In the case my fiancé don't ve taxe fill for 2013 ,

Because she start work oct 2012last year, and we already got noa2 waiting for the hardcopy so I'm wondering using the paid stubs, bankstatements & job letters is this enough for the support,

She said that untill 2014 she will be able to get tax fills

For the income requirement does this mean you have to have this amount in the bank or you have to annually be making this amount? If I have to annually make this amount then what form does my co-sponser have to fill out?

For annually she make $32000 plus and right know she make up to $24000, so is this Gud we use pay stubs without tax fills coss we can't get those untill march 2014.

No, You need the tax filing(s). You can always get your tax transcripts for free from the IRS. I ordered mine for the last three years, and received them in about a week. Again, free of charge! You will need 2012 and 2011 transcripts...maybe 2010 depending on your consulate's requirements.

you need to earn 125% of the poverty level per year. If you earn close to this 125% annual guideline, then you will probably want to include bank statements showing additional funds on hand.

This is from another thread that involves your question about which form to be used:

"Many consulates follow the guidelines for the I-864 even when using the I-134, and that includes the 125% instead of 100%. The USC petitioner fills out an I-134 and provides their supporting documentation. The co-sponsor fills out their own I-134 and provides their supporting documentation. They should also include proof of being a USC or LPR".
