Re-Issue K-1?

Has anyone successfully lobbied an embassy to re-issue a K-1 visa? My French fiancee came on a K-1 in July, but had to leave in October because of her parents' health. We didn't get married. I've emailed the embassy in Paris, but they say they can't re-issue the visa because we didn't get married. For reasons of which you're all acutely aware, we really don't want to go through the I-129F process again!!!

Never have heard of that. You'll need to go through the entire process again.....or get married there and petition for a CR-1....this way she can stay there to take care of any business necessary.

I don't have any experience on this, but from all I've read, I don't think you'll get lucky. The rules of the game are very, very clear. You had 90 days to get married once she entered in July. It should have been done by October, regardless of her having to leave. If you had gotten married as soon as she entered, and applied for AP; you might not have this problem in your hands anymore.

So, what can you do now? Either get married and apply for a spousal visa or simply go through the process again.

02/14/2014 - Case shipped to Embassy, where it waited for over a year at my request                                 11/07/2015 - AOS approved (EAD and AP had already been approved) - there was no interview

05/21/2015 - Interview - Approved

The N-400 journey:

02/16/2020 - N-400 application filed online

02/21/2020 - Paper NOA received in the mail

03/13/2020 - Biometrics

02/02/2021 - Interview & test - Approved

02/05/2021 - Oath Ceremony

According to your time line your visa was approved in January, waited the max to use it, then another nearly 90 days?

What gives.

They could reissue is she never left and was delayed because of uncontrolable cirumstances but she used the visa to come you need to start out all over again new fees new wait new medical

This will not be over quickly. You will not enjoy this.

How frustrating! What a waste! Why didn't you go quickly to the court house to be officially married before she leaves the US? ohmy.png

I am really sorry for you guys but it sounds like you will have to start from the beginning.

Don't be sorry. They knew what they should do and made a conscious decision to do something very different and understood the consequences. The health of the parents was more important at the time.
