Hello Vjers,

I received a notice of intent to deny from USCIS today and the reason was failure to respond to RFE (I never receive any RFE and no status update on my case). In the NOID letter, they wanted a new vacination paper from a civil surgeon even though I was vaccinated and completed all necessary medical examination before I came to the US. My questions are;

1. What do I do next?

2. Do I need to pay another money to a civil surgeon here even though I got all the medical done before?

3. Worst case scenario if I have to do another one, is there any cheap one in North Carolina? And how much does it cost?

Plssss note my application is an interview waiver case based on the letter I received from USCIS office in Raleigh.

NOTICE OF INTENT TO DENY

This is your notification of the Service's intent to deny your application to Register Permanent Resident or Adjust Status(Form I-485) pursuant to 245 of the Immigration and Nationality Act, as amended(the Act) Section 245 of the Act states in pertinent part: An applicant or petitioner must establishthat he or she is eligible for the requested benefit at the time of filing the application or petition. All required application or petition forms must be properly completed and filed with any initial evidence submitted in connection with the application or petition is incorporated into and considered part of the relating application or petition. The record shows that you failed to bring your scheduled interview items required by the applicable regulations and/or the form's instructions and consequently, have not established eligibility for the benefit sought. Please comply with the following:

X Review of the vaccination form indicates that you may be missing a required vaccination. Please submit evidence you are current for all age specific immunizations. Please submit a properly completed Form I-693, Report of Medical Examination and Vaccination Record. The medical examination section does not need to be completed, but the vaccination record must be completed by a civil surgeon who has been designated by USCIS. The Vaccination Record (documentation of immunization) is documented by completion of: * Part 1,* Part 3, and * The Vaccination Record.

The civil surgeon must conduct the exam as directed in the instructions to Form I-693 and in the Centers for Disease Control's Technical Instructions for the Medical Examination of Aliens in the United States. Both the medical examination and the vaccination record must be completed when required. Please note the form must be sealed in an envelope by your examining physician. The unopened envelope should be returned to the U.S. Citizenship and Immigration Services (USCIS). In accordance with 8 CFR 103.2 (b), you are hereby given (30) days from the date of this letter to inspect the evidence in this case and offer written evidence in rebuttal. If you submit a document in any language other than English, you must include the English translation. The translator must certify that the translation is accurate and that he or she is competent to translate. If no explanation, rebuttal. or evidence is received within the time given, the case will be decided on the present evidence.

According to that your vaccination records were incomplete and you will need fill i-693.

To check if they are right you can check a copy of your ds-3025 (if you got one at the medical) Do you have ticks next in "not age appropriate", dates or vaccines or VH note in ALL rows? Does it have ticks next to "incomplete" and "may be eligible for blanket waiver" or "complete", is the form signed and stamped by a doctor?

If 1 or more ticks is missing (could be just an omission) this would be the reason why they reckon it's incorrectly filled.

Yep, so you just need the vaccination transcription part done, not the whole medical, because your vaccines were not complete.

Call around and find a CS who will do a vaccine transcription only, and it should only cost $25- $50. There is a thread here called "Civil Surgeons who do not rip you off" with a list to help you.
