PLS HELP. What happen if i get denied for my interview CR1? can i still visit the states with like a touristvisa??

im from austria vienna.thanks

It will make it very hard because you showed immigration intentions and now a denial they may fear you won't go back. All you can do is try if denied. But very unlikely.

Is youe country a ESTA or VWP? that might help maybe.

hi,thanks for your answer.ITs ESTA... i have tomorrow my interview and im sure it will be denied because i had a few years in prison for drugs.almost 10 yeard ago.i have a doughter 5 months old and they live in NY.if they really denied the visa i really dont know what to do and there is no chance for my family to live here in austria.

You may need to look into waivers if it is denied. Report back after your interview, and some folks will point you in the right direction if it goes badly.

* Naturalisation (Citizenship) via Phoenix Lockbox

Yes looks like you may have to get a waiver. Don't count yourself out dear. Things may still work out. Let us know how it goes tomorrow. Please have hope k.

they said today in the interview that they need 1 week to see all the police records,because its to much.he also said that it looks bad.so lets see.

Depending on the severity of the conviction, this could be very bad, or just bad. If it was a conviction for selling, smuggling, importing or trafficing drugs, it's very bad, and will likely end up in you being denied, as well as a denial for a waiver.

If it was for a drug purchase for private use, or drug usage, they may allow you immigrate if/when it is established that you are drug free. This also depends on what kind of drug. I.e. marijuana is treated a lot lighter than for example heroin or cocaine.

To answer you first question - Can you still travel to the US?

The simple answer is, likely, no. Again, this depends on the severity of the conviction. You can no longer use the VWP/ESTA because of your record, so in order to visit, you would have to apply for, and be granted a B-2 visitor visa. Having shown intent to immigrate (by applying for a CR-1), as well as having a prior drug conviction, it is highly unlikely.

Put it this way - If the drug conviction is serious enough to have a CR-1 visa denied, it likely is serious enough for a B-2 denial also.

If your visa is refused, why can't your family live in Austria? If they absolutely cannot, you may qualify for an I-601 waiver. This is not DIY. Lawyer up.
