It isn't a secret. And k3s are no longer issued because the timeline for the cr1 is not years and years like it used to be, the timeline is the same. The k3 was used when it took years for the cr1 to be issued, now it only takes months. Before stirring the pot, know the facts.

Why don't you get your facts correct. when you applied it was taking months, happy that you got approved within 4 months , now they are saying 16 months and then NVC and Consulate so close to two years.

Wow, Stirring the pot? No just asking for a K3, that should be an option for us but is not. K3's are set up to process in 30 days. I see your timeline (got thru to interview in 220 days) so I can understand why you would think this is a matter of months for everyone. But alot of us are now waiting 11 months (or more) just for a NOA2 on the I-130. Then the NVC which is slowing down alot now. But then again, you sound like you got it all figured out so tell me how long is it taking for a CR1-IR-1 today?

K-3s were issued in 2009 when the I-130s were taking about 11 months.. NOT YEARS... And I am not sure which planet you live on, but the I-130's here on Earth are taking a very long time. not just months these days. Don't hammer these guys for stirring the pot.... It seems like you took on that job...

My attorney pulled me back in his office to file the K-3 6 months after I filed my I-130 because he received word that they would be re-starting the K-3 processing due to long I-130 processing backlogs. Lawyers just don't make up that kind of #######. and no, he didn't charge anything extra and it was more time consuming on his part... he also pulled every one of his other clients who had a pending I-130 and filed the K-3.

Also, the Ombudsman's office told me they see K-3 approvals all the time.. Know YOUR facts.

And for all of you who say the K-3 is obsolete... Ok, then explain why it is still offered on the USCIS website ( for free) and why they still post processing times? Why clog the system with a file you never intend to process? Just something to think about. and just because there aren't that many stats on K-3s here on VJ doesn't mean they don't exist.... smh

With respect to the Ombudsman's office, all they can speak to is approved I-129F petitions that were filed to start the K3 process. They (or anyone else at USCIS for that matter) can't say anything on whether K3 visas are actually issued because they have nothing to do with the actual issuance of a visa (that's the State Department's territory).

As for why you still see it on the USCIS website, the provision in the LIFE Act that created the K3 has never been repealed. I'll surmise that those who speak to the K3 being obsolete reference the State Department's policy of administrative closure of the K3 whenever they have an approved I-130 on-station.

I can't speak to what USCIS is doing these days with I-129F petitions that are filed to start the K3 process (I'll let those who actually file the two petitions do that). However, I can speak to State Department policy of what they do with it because their procedures remain unchanged.

In the most recent chapter of my futile attempts to find anyone who knows anything, I exchanged a few messages with a lawyer in my state. She sent me this gem in response to my pointed comments about USCIS's performance: "Welcome to the beautiful world of Immigration. Be 'thankful' you are not in jail while this is happening. Many many petitions (U visas, N-600s, I-130s) are taking a long time right now, over one year. Just try to be patient and it seems like you are doing all you can to look into the matter. Best of luck."

JAIL? What in the?! Absolutely incredible, I wonder how she came up with that one. I'm so glad I've never paid for one of these jokers. It's not just USCIS that's messed up, it's every single idiot like this who drinks the Kool-Aid and never thinks to question what's happening. No one, on any level at all, cares what's wrong.

Yeah, it was all to brag. No offense, but people who are looking at a total wait time to be with their loved ones of 16 months to 2 years don't really want to hear how someone got their entire process done in half that, as your timeline says. It's kind of like putting salt in the wound.

I wish if there was some type of setting in this forum that if you are applying to K-1 then you can only post in that section and every time you try to post some where else, a pop up comes up and tells you permission not granted. Kinda saying "Non of your business this is CR-1 thread" and it should apply for us too so we cant do the same thing in K-1 section, but then again this is a public forum so that would be asking too much, if only people had tiny bit feelings world would be a better place.

No, i dont want to slow anyone down. I'm happy for anyone that gets approved.

I just think the USCIS could do alot better in this day and age of the internet and scaned files. Letting things slow down this much is not what good managers do. Not over and over at least.

Heartless that the K3's dont process as fast as the K1 are lately. Thats not a luck of the draw, volume based problem.

I think we should be careful to not fight each other (meaning the CR1/IR1 vs the K1 or F2a,s). Like horses bitting each other in a burning barn.

What we all need is more people working at USCIS getting the work done in a timely manner for everyone.
