Hello All!!!!

I don't know if its just me or someone else is going through same BS from USCIS! We've filed an i130 petition in March and still no NOA2! Isn't that just crazy? I noticed people who filed in August though for a K1 get approval within 2 months! What da hell is wrong with those guys giving priority to people who aren't married while keep those legally married apart for long?

You assume that an immigrant visa for a beneficiary from Nigeria is the same as a non-immgrant visa petition. It is not. You then assume that the difference is because there is "something wrong with USCIS" There is not.

K-1s are not immigrant visas and do not grant permanent residency. For a K-1 that is a separate process which is done after the marriage in the USA. CR-1s grant permanent residency upon issuance. A K-1 is only "half done" when they arrive, a CR-1 completes the Permanent Residency process before entering the US.

You had a choice of visas, of immigration paths, and you chose the one which takes longer to get a person into the USA. Why did you choose the route which takes longer for your spouse to arrive? There are benefits to it, so I presume you made that decision based on the benefits offered by the CR-1.

Married couples file for IR/CR-1. There is no choice in the matter. We can file for the K-3, but USCIS doesn't want to grant those to us. No choice here...

The problem is USCIS is not letting the K3 Visas go thru. Then a USC could get the family together just as fast as the other K filers. Thats what is wrong. Big secret they are keeping.

It isn't a secret. And k3s are no longer issued because the timeline for the cr1 is not years and years like it used to be, the timeline is the same. The k3 was used when it took years for the cr1 to be issued, now it only takes months. Before stirring the pot, know the facts.

What about people who've been married for years? and just now decided to move to the U.S.? Did they have a choice of visas too?

Is it gonna heat up in here again?

Let's all agree on one thing: USCIS needs to balance workload and anticipate problems better. They allow backlogs to accumulate, and then respond, causing months-long delays from sending files here and there.

I had no choice of visas or immigration paths. I'm not a CR, I'm an IR. And they don't appear to be processing K3s.

There actually is something wrong with the USCIS. Their processing goal for the I-130 is 5 months, and they post that it's taking 11 months. Many VJ members have reported getting notices from the USCIS stating that because of a backlog, petitions will be transferred to other service centers around the country.

Let's not devolve into another K1 vs. CR1/IR1 debate. What matters is that the USCIS is not meeting its own performance goals, and it would be pretty great if they could fix whatever has thrown them off track for I-130 adjudication.

Really now?? We sent in our petitions expecting the normal, historical processing time of 5-6 months for an I-130. NOT the current 11-16 months. Have you not seen Igor's lists recently, or the processing estimate on the USCIS website??? It's taking forever to get a spouse here now, and it wasn't this slow before. Trust when I say that spouses would much rather go through the process K-1s are going through and only be "half done" when they get their spouses here because then they would at least be allowed to BE with the one they love while everything is being processed. I have a child on the way and I'm expecting that it will be able to walk and talk by the time I'm actually allowed to live with it as a family with my wife and it's not even born yet! Callous, cold remarks are what really make CR/IR-1s so darn angry that others on the forum have no empathy for our situation and just see it as us blowing things out of proportion and that we should just put and up and shut up. Maybe we wouldn't have chosen this route that takes spouses longer to arrive if we had known that it would taken 11-16 months to finally be reunited with out spouses. So yes, there is something definitely WRONG with the USCIS given the fact that they are processing I-129Fs blazingly fast and letting I-130s languish and collect dust, when they could be spreading everything across all of the service centers and giving everyone the chance to get their petition approved in a much quicker and more efficient manner.

Know what facts? The CR1 doesn't take only months now. It takes 11-16 months, and at times 2 years. Have you looked at Igor's lists and the USCIS processing times they have posted recently? Know the facts.
