CR1/IR1 vs K1. Yes CR1/IR1 should take priority. What laws apply to any other country does not matter. In the US, marriage is a much higher status of relationship than being fiance or BF/GF. Example: I can not add a fiance/BF/GF to my taxes or health insurance.

Well I'm glad my fiancé will be here in less than a month so out relationship can finally be at the higher status of marriage. I still think its crazy to be insulting K1s. We aren't just some bf/gf, we want to get married and are going through all this work just to do so. I think that shows a lot more dedication to the relationship then an average couple who can get married without getting permission from the government. The only different is the order of marriage versus visa. You don't know the reasons people pick visa first than marriage. Maybe they can't see each other again for many months and instead of waiting they file K1. At the time I picked K1 I thought I had to go to Brazil to get married which would have delayed filing for over 6 months. So I picked K1 because I wanted to get married ASAP and the only alternative I thought was too slow. Actually probably should have got a student visa then married but didn't know that was an option either. I was very lucky my fiancé could be here for up at 6 months at a time, but if he had 2-3 weeks of vacation like me? Marriage wouldn't be possible without a long wait, then the wait of a visa. But yeah, you guys totally deserve to go first because I picked the lesser visa for a lesser status of relationship.

I agree with the idea of:

Marriage shouldn't be something USCIS holds against you while getting a visa for your partner.

Not:

Marriage is higher status than fiancé therefore I should get processed first because I picked marriage -> visa instead of visa -> marriage.

You do not need any permission from US government to get married.

K-1 does not grant a marriage permit, but simply allows to enter the US to get married and stay.

After POE you can still choose not to marry, without any consequences other than beneficiary would have to go back to his/her home country.

Marriage has legal effects and consequences, while engagement does not.

I don't know how can anyone not see that marriage IS superior to engagement.

That said, we would never be having this discussion here if USCIS wasn't neglecting I-130 filers and giving priority treatment to all other kinds of visas and petitions.

NO, its not giving permission to get married. You are able to marry whoever you want, whenever you want. The government has NO SAY over that. The K1 is a visa to enter the country because you want to get married here. The government does have a say over that.

The visa is to enter the country only with a stipulation that you get married within a given time or go home. People on this forum are very sensitive to the processing times and those who jump on and say things like " I don't really care about spousal visas because I didn't pick that" If you're done, then be done. I personally am exhausted from reading your posts.

Married is Married.. Those of us who already made that commitment are suffering with these long processing times. Nothing anyone can say can change my mind about Married vs. Fiance. In my opinion, being married speaks volumes about the intent. You cannot compare a 3 month wait for a couple who is not even married yet to a 10-16 month wait for a couple who already got married and are trying to hold their life together .

It is the USCIS that is to blame for the backlog and the poor planning . I don't care about the cost, I just want to be with my husband. These are months and months we can never ever get back. I am sure most people here would be glad to pay an extra $1000 to adjust status if they would just allow their spouse to enter while waiting for their approvals. The K3 was supposed to be the answer for that, but what's the point if they are taking just as long to approve those too?

NO, its not giving permission to get married. You are able to marry whoever you want, whenever you want. The government has NO SAY over that. The K1 is a visa to enter the country because you want to get married here. The government does have a say over that.

Isn't there a separate thread or as i call it "happy place" for people with K-1 to discuss their experience with other. Personally no one on CR-1 section is gaining anything from their experience so why not the right people, the one with CR1 experience have discussion here that way i can learn something that is actually useful to my CR1 application. No disrespect to anyone but isn't that the reason why the forum has different sections for different type of visas.

Agreed!!! It sort of bothers me these comments "well my fiance will be here in a month" It's like nah-nah-nah-boo-boo, we're done and you're not, even though you applied months before us.

I'm lucky to be living with my husband, I know how hard it is to do long distance, we did it for years. But I can only imagine how hard it would be to go through this horribly frustrating process while being long distance. I sympathize greatly with those couples who are not able to be together during this process. I would never say my situation is similar to theirs and I would never rub it in their faces that I get to be with my spouse while they don't.

Emotions run high on this forum. Have a little empathy, and realize when you're a lucky one.

They (the K1's) would feel different if the roles were reversed. So it makes me wonder " why can't the CR1 and the IR1 just bring our spouses home too"? We have the same process? The difference is... that the K1's have a probation period of 2 years. (then adjust status) . so they get to figure out if marriage works for them or not! We on the other hand.. especially the IR1's have already been married over that.. So why can't our spouses come home to America... finish the paperwork and NOT get the ... ( ooooh so wonderful GREENCARD) until the paperwork is done?

America is STILL LETTING people in on the K1 visa .. that might not ever get married or disappear and never leave... so why can't everyone's significant others come home? Let them ALL IN why not? Because you can not justify to me.. all the debates over boarders, and security... that some how the K1's are safer risk.. then the Married CR1 or IR1's... they are easier maybe? I don't know.. but IF FAIR IS FAIR.. then we should all be able to be together with our loved ones.. until the immigration process is over...

So that being said.. the K1's would feel different if the shoe was on the other foot...

I am happy for you that you get to end your distance in a Month... BUT that being said .. don't rub our noses in the poop on the rug ... we are people with kids (some) and long waits either already behind us.. or still in front of us.. Your wait is over soon you will not only be in Marital Bliss.. but you will get to sleep next to your loved one every night. We CR/IR1's get to sleep with a bright Skype computer screen.. fun.
