Need help/suggestions about marriage (nonimmigrant) visa (Peru)

Hello,

I was hoping to find some help and/or suggestions about the visas. I will be getting married very soon here to the girl of my dreams. :) And we were wondering about the visa. Mainly, we are worried because she and I are both 24 and are both foreign here in Peru. She is from Central America and I am from the US. Anyway, I would like to know if the fact that she and I are two foreigners wanting to go from Peru to the US will cause us problems or help us. As I said, we are both 24 living out here alone for the past 3 years supporting ourselves. Apart from that, I have been here for 3 years now and so obviously I don't have a job lined up in the states and I feel that this might go against us even though I know my family would be more than happy to watch out for us until we got jobs. Is it possible that I could just get a sponsor in my family that claims they won't let her become a burden?

I also wonder about the nonimmigrant option. She and I had a blast here, and even though I earn fairly well here, I feel that I could give her a much better life in the US. Would our age and the lack of a job in the US at the moment have them deny us that? I feel that if they grant us that it would give us enough time to get up on our feet and prove to them we won't be a burden. I am kind of running in circles here but I am a little tired so please excuse my terrible writing.

To sum it up:

Will the two of us being foreign and marrying in Peru have any effect on the visa decision?

Will our age cause any problems either?

And will me not having a job in the US right away get us denied?

Please if you have any suggestions and can help with this information I would greatly appreciate it. Also, if you have any questions to further get an understanding or if you didn't get what I meant then don't hesitate to ask.

Thank you!

There is no non immigrant visa that allows you to live in the US and with a US citizen spouse she is not likely to get a visitors visa. You must prove that you can support her to get her here on an immigrant visa. A family member or friend can help with that requirement.

This will not be over quickly. You will not enjoy this.

Hey, your age will not stop you from sponsoring her. The CR1(spouse) visa is way longer than the AOS (adjustment of status) Sometimes people may get the turist visa denied just because they are young and have not strong ties to their countries. I'd recommend a student visa for you gf and come to the states and apply for the AOS here. I think it'll be way easier (that is what I am doing now). And not having a job wont hurt as long as you have a joint sponsor (family or friend) My mother in law is our joint sponsor. So dont hurry in making a decision research and see what fits your situation better!!

Good luck and enjoy my beautiful country and eat some lomo saltado for me!

Mia.

I had considered her doing the student one but she is already finishing up her career so it wouldn't be possible.

On the US government page I saw about the nonimmigrant visa. I believe it is the K-3 one. It said something along the lines of "shortening the time separated from your spouse".

i say chase an immigrant visa, category CR-1 or IR-1, after marriage.

We've a guide for that, in the Guides section.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

That is possible. She does want to go back to her old level of English. I noticed that we have a USCIS office here and can directly file with them. I saw this can take a few weeks to three months for the interview. When we receive the interview does that mean we can go to the US if we get approved? Also, if we do the ESL idea, would us being married cause a problem for her changing status? I like that we can file here because it will allow me to explain that I have plenty of family willing to help us out and, I don't have anyone in Miami, but I could have a job because mine could transfer me there.

Using a non-immigrant visa to immigrate is fraud.

A k3 was used when the CR1 visa took many years. About 3 years ago almost all K3 visas were closed because they run about the same approval time as a CR1 and the CR1 is a better visa.

I think I may have worded it wrong. I saw that on the US website for visas they talk about the K-3 visa, which is a nonimmigrant visa to cut down on time separated.

Do you know about DCF? I have a consulate here in the city and I saw that they accept the I-130 and G-325A processing. I heard that going through DCF can take a few weeks to a few months to get a interview. Does the interview determine if we get the visa or not?
