Co-sponsor at USEM in Manila

It is because we got rejected and we had a co-sponsor. So now, we're gonna go thru with CR1/IR1 Visa.

I was actually surprised that the CO asked me to find a co sponsor, he was not smiling in the beginning and when he said that my fiance's income is not enough i was already shaking but when i heard the magic words "co sponsor" i hurried in giving him all the documents we have prepared, and as per Hank's advise i also had i864 ready signed by both my fiance and his mom. But the i134 seemed to be enough for the CO. I am really thankful that we were approved. I think the CO looked into 125% of the poverty guideline because i am pretty sure we hit the 100% mark. I believe it varies on the CO that would handle your case. I heard there were some that were not allowed to have co sponsors and others just hit the 100% and got approved.

AOS- Adjusting from K-1 Visa

  • March 7, 2014 : Filed AOS packet via UPS
  • March 11, 2014: Received by USCIS
  • March 19, 2014 : Fingerprint fee received
  • March 20, 2014: Checks Cashed
  • May 5, 2014 : Biometrics Appointment
  • May 22, 2014 : EAD/AP Approved
  • May 31, 2014 : EAD/AP Combo Card received
  • June 27, 2014 : Notice of Potential Interview waiver
  • January 21, 2015: RFE for Marriage License
  • February 25,2015: Updates:(Text & Email): Card being ordered to be produced, Card in Production, Welcome letter mailed.
  • March 2, 2015: Welcome Letter received dated February 26, 2015
  • March 3, 2015: Case update : Card was mailed.

Well, goodluck! 'Cause I had my mom co-sponsor us, they didn't take it. Then, we submitted more docs after I got a second part time job, which puts me into 100% above poverty level, and still submitted a co-sponsor from my step-father.. and we got a second refusal. We have a kid together too, but they really don't seem to care about that. Try to go thru with it, cause it really depends on your CO. If not, then go thru CR1/IR1 route.. 'cause my son and I are going back to the Philippines, so my boyfriend and I can get married then file for CR1.

Did your mom's income meet the poverty level (amount determined by counting herself and any dependents + your fiance and any minors on the petition)?

Same with your step father?

Just found out my NOA2 approved Oct 25, 2013 is still good. Was automatically extended by the embassy until one year of the last date of notification which is Dec 3, 2013. It's a race now.

Yes.

On October 2013, our I-129F Refused under 221(g)

So our son and I went back home to the PHL..

Right, it depends on the CO. But I feel like it's unfair for others who get the lenient CO, and others get the strict CO. If they really aren't taking co-sponsors, and that's what they want to establish. Then, if the petitioner of the K1 visa does not meet the poverty guideline, the visa should be refused or denied. No dilly-dally about it.

But it is also non-sense how they take co-sponsors for everything else but K1, when it all ends up the same way.

I'm going to the Embassy as soon as I land in Manila.
