I'm the petitioner and I'm in college right now for HVAC/R and I'm wondering about the co-sponsor situation. I don't have an income because I'm in college as of now, but I will soon be done in maybe 2 months. My co-sponsor is my step dad and he made 95,000 dollars last year. I did the I-864 and the I-134 and got his boss to write a note saying how long he has worked for him and I got w-2's for the last 3 years, check stubs, bank account information, etc My fiancee is also 5 months pregnant.and is not working at the moment. I know that Manila frowns upon co-sponsors, but will they make an exception or will they throw our case right out the window? What is your thoughts and opinions? From what I have read on here, it seems like most of the cases that have co-sponsors get approved. I don't know about mine though.

There is no way of knowing what motivates USEM to accept a co-sponsor with the K-1. You have the I-864 and the I-134 which is always good to have from you and the co-sponsor. You need the most recent tax return and W-2 from each of you (yes I know... but I say it anyway). USEM wants the co-sponsor to be family so you are good there as well. Now you cross your fingers.

Your fiancee being pregnant has zero bearing on USEM accepting a co-sponsor.

hi I just finished my interview today and what i was asked was the most recent 1040 and w2 my fiance's income accsg to the CO was not enough so he said i need to find a co sponsor good thing that i have his mom's signed i134 and most recent paystubs,1040 and w2, after looking at the docs i submitted for about 2mins he said everything is good and I got approved!!! Praise God! always be ready with documents!! i was lucky that i was armed with original documents and photocopies that can support the petition.Thanks to all the VJ'ers help :)))

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

6th August 2014: EAD Approved, AP still in initial review
12th August 2014: got tracking number for EAD
( ) August 2014: Received EAD (I forgot what date I got them but I did receive them less than 5 days from the 12th)
10th September 2014: Interview Waiver received (I wished I was interviewed)
April 23, 2015, we registered your permanent resident status and mailed you a Welcome Notice

They are absolutely true. Many have been rrejected. But lately, several have been approved. Perhaps USEM is relaxing the rules.

The best thing to do is apply and try.

Getting approval for a co-sponsor in the past and continues today is that sometimes it flies and sometimes it doesn't. If you have a strong co-sponsor with good documentation, there is a relatively good chance you will be approved. I believe it is based on how strong your co-sponsor is. If it were me I would move ahead and see what USEM will approve. Nothing is more predictable with USEM but that they are unpredictable. Wayne Gretzky (famous NHL hockey player) once said "you miss 100% of the shots you don't take".

So, all the rumors about Philippines not accepting co-sponsor isn't true?

It is because we got rejected and we had a co-sponsor. So now, we're gonna go thru with CR1/IR1 Visa.

On October 2013, our I-129F Refused under 221(g)

So our son and I went back home to the PHL..

Well, goodluck! 'Cause I had my mom co-sponsor us, they didn't take it. Then, we submitted more docs after I got a second part time job, which puts me into 100% above poverty level, and still submitted a co-sponsor from my step-father.. and we got a second refusal. We have a kid together too, but they really don't seem to care about that. Try to go thru with it, cause it really depends on your CO. If not, then go thru CR1/IR1 route.. 'cause my son and I are going back to the Philippines, so my boyfriend and I can get married then file for CR1.

Congratulations!!! Great to hear that your co-sponsor was accepted. I have a good co-sponsor and I'm in college, so I have a pretty legit reason for not working. I just hope they see it the way that I do.

Yes, you need to complete the I-134 also - it is listed as required in the embassy instructions letter.

One more suggestion is that you write a letter explaining that you are a full time student and will be graduating in two months.. and so on and so on ....

You having ZERO income is something the embassy will look at hard even if you have a co-sponsor, so they need to know your complete situation and that you will be working soon.

And keep your fingers crossed.

Thank you for the advice. I will be sure to type up a letter and sign it. I've got about a 3 lb packet right now, so lets see where it takes us! I should be scheduling an interview around two weeks or so. *Keeping my fingers crossed* happy.pnghappy.pnghappy.png
