AOS 2013 Tax Requirement

Hello nice members,

I have a question and I need your opinions on this.

When do they legally or logically start requiring 2013 Tax papers/returns instead of 2012?

I am asking this because it is quite possible that my case will be completed by the end of November. But, we will not have an interview until late February or early March 2014. As you know, the deadline for filing tax returns is until middle of April. And our sponsor usually does it late.

My logic is that they cant ask for 2013 tax papers before the deadline. But I am kind of worried about it. Does any of you nice people have an idea ot heard something on this subject? When would they require you to have 2013 tax papers as the most recent one assuming you get to the interview in early March?

Good question but logic would say when its due April 15. My best guess but others would know for sure. Good luck

I am curious of your timeline as none show. Does it mean nothing has happened for a year? Wow

28-Sep-2016 Interview, both of us, separated, not hard, 10 min. each, result---said hubby will get GC in about 10 days

10-Nov-2016 Card is Delivered!!!! YAY
CITIZENSHIP: 

Biometrics appointment for 2020-03-27 has been cancelled until further notice as all field offices are closed because of COVID-19.

***NOA dated 12/10/2020 USCIS stated they are able to reuse previous Biometrics***

Interview was easy. My hubby's Oath Ceremony is scheduled for February 25th. I can't watch >sad< but happy he is getting his certificate!

I can share with you what happened to us. I filed for the visa in November 2012. Of course I had not yet filed my taxes for the tax year 2012. I had included my 2009, 2010 and 2011 tax transcripts with the initial application. When we showed up at the embassy in Manila for the interview in July of 2013 the Filipino consular asked if I had brought the 2012 tax documents with me. I did not have them with me because I assumed that everything was okay with the initial filing. As you can imagine I was about ready to pass out when the Philippines consular said it would be up the the US Counsel if we would be denied based on this. Well when we got to the American Consul and the interview we did not bring up the fact that I did not bring the 2012 taxes with me. Fortunatley the American counsel never asked for this and we were approved. I guess my point is this: If I was to do this again I would certainly bring a copy of my taxes, even though they were filed after the visa application to avoid any problems. If the interview is after April 15 I would bring them along to be safe. Good luck and God Bless,

One more thing I would add: Be careful, if the taxes have indeed been filed and taken care of before your interview do not lie about it as they may very well have access to your and your sponsors tax records at their disposal. Not sure about this but I would play it safe. Of course I am not suggesting that you would lie. That is not what I mean. I just know sometimes the paper work can get overwhelming and just want to make sure you play it safe.

As long as your interview is before April 15th of 2014, I wouldn't worry about a return for 2013. If by some chance they want you to bring in a return for 2013, they should list it on the interview letter (giving your sponsor plenty of time to file). However, I highly doubt they can require a tax return before it is due. Good luck.

8/26/2013 DS 3032 (Choice of Agent) emailed by beneficiary

8/28/2013 Received emails with AOS Invoice and DS 3032

8/28/2013 AOS Fee invoiced online and paid.

8/29/2013 AOS Documents mailed via fed ex overnight

8/29/2013 AOS Fee shows as "Paid"

8/30/2013 AOS documents received by NVC

9/3/2013 NVC substitutes DS 261 for DS 3032

9/4/2013 Filed DS 261 online

9/6/2013 NVC accepts DS-261

9/11/2013 Received email with IV Fee invoice. No ability to pay online. (5 business days after DS-261)

9/12/2013 Pay invoice as soon as it is a possibility.

9/12/2013 Mail IV Package

9/13/2013 Fed Ex. confirms delivery of IV package to NVC

9/14/2013 IV Fee shows as "Paid" and DS 260 is available for completion.

9/14/2013 Submit DS 260

9/16/2013 NVC records receipt of IV Package

9/24/2013 - AOS Accepted (16 business days)

10/8/2013 - Case Complete (IV Package and DS 260 Accepted in 17 business days)

10/15/2013 - Interview Scheduled


11/21/2013 - Interview Date

David and zolia. Thanks for alerting me about things. Our interview will definitely be before the deadline of Tax year 2013. So, it will be an slightly different situation than you guys since you did it in June (which is after deadline).

You know guys.People can also ask for extension up to October 15. That would again make it a further dilemma. But as most of you said. At least for my case, its probably safe. My sponsor is almost always an "extension" type of dude (Brother in Law).

And sorry I have not updated my timeline since I registered. Recently became active. Will get to it now.

Thanks and keep it coming please. May be someone out there has a first hand experience of such situation.
