I have not filed my 2011 and 2012 tax returns due to not having an ITIN (W-7) number for my wife yet and various other reasons. They are done but I can not file them without an ITIN number which I applied for 2 weeks ago ...They will be filed as soon as I receive the W-7 number which could be as long as 8 weeks. I did not have the returns with me when I filed for the W-7.

I would like to file my I-485 and I-864 within a week. If I send copies of the returns that I plan to when I file (as soon as I get the w-7) for the I-485, I-864, will this be enough to get my applications moving. I could be up to 2 months to get the W-7, who knows.

Any advice on this would be appreciated. Is it alright to file the I-864 now with copies of returns I plan to file and wait for the RFE?

July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

copies of what you filed, are perfectly acceptable.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

That's not a reason to not file your taxes. You can always file as Married Filing Separately and amend it later.

you could be have thousand excuses to do not filing the last two yeas of your taxes. They also have a thousand excuses to denies your visa

some time pay stupid work but sometimes do not .... file your taxes as soon as possible and be sure that you sent copies accepted by IRS

Those taxes are not possible to do by TURBO TAX they do not allow you to do that ... have to be hard copy by mail. after they approve it

you clear to go and IRS will take a month to do so. whistling.gif

My advise is to clean what you own to the government and then ask for you visa ..doing IN YOUR WAY do not fly. wub.png

You can't send copies of taxes you didn't yet file. They check it against the records and will see you are BSing them. No. Actually, somewhere in the laws it says a person who didn't file on time must submit tax transcripts.

8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

Still, you can't show what you haven't filed yet, and expect it to be legit or even 'count'.

You've a copy of 2010(I think/hope?) so submit that, with a cover letter explaining your filing debacle and the facts that you've presented in this topic and your other topics. Expect an RFE, but IMO, even getting an RFE has bought you more time (but sucks on the back end for getting docs in, though is helpful for buying more time that you need).

I hope that makes sense.

You are very kind. Yes I have copy of 2010 so I will send that and letter of explaination. Yes makes sense.
