Sponsorship of Affidavit of Support (I-864)

Hello, VJ'ers -

Need help to sort out the SPONSORSHIP of filing the Affidavit of Support.

My wife is the petitioner and currently filing the F2A immigration visa for her child. Since she does not have a job yet, I will be the only one to sponsor the immigrant.

Which forms should we use for the Affidavit of Support? I feel that we might have two possibilities -

(a) I file I-864 and check the box of "I am the only joint sponsor". Does my wife need to file one I-864 (or I-864EZ) even if her income is zero?

(b) My wife files I-864, put down her annual income as zero, and then put my name, Relationship, and current Income in Part 6. I will need to file I-864A separately.

How old is the child?

as the primary sponsor, she will file the i864 as sponsor

you will file the i864A as household member.

I think the reason he asked is he is wondering why you didn't petition for the child as the child of a U.S. citizen. If you married the mother before the child is 18, then you can petition for him/her as your child; it would be immediate relative category which is faster than F2A.

Ah - Thanks for the clarification -!

The child was over 18, when we were married. I thought we would not be able to file immigration visa for her, as the wait would be long for F2A visa typically.

But, the fact was we filed the case on 9/05 and got the NOA2 on 9/24 - faster than other IR1/CR1 applications I knew. Somehow, USCIS is accelerating all F2A applications!
