Hi there fellow posters,

I'm going to be as brief as possible hoping someone can help me a bit with this one.

I'm a citizen of Argentina, back in 2000 my country was one of the few countries that would allow citizens to travel to the states under the VWP.

2000 - Finished High School and went to the United States, stayed for 2 months <-- 17 Years old

- While in the states, obtained a Canadian visitor VISA and went to Vancouver for skying

- Flew back from Vancouver to the States, overstayed VWP for like 20 days, left the country by myself to get back with my fam and start college

2001 - H1B VISA denied -- I had no college degree, I assume that's why. <-- 18 Years old

2005 - Police ran a search warrant at home looking for my dad, I was booked in but all charges were dropped <-- 21 years old

- Obtained a letter from the Grand Jury saying none of these charges would affect my name by ANY means

8 years later (2013) I want to travel to the states for vacations, I have a pretty decent job, own a pretty nice car (BMW), own property, and work for the GOV.

What are my chances for a B2 visa? What would be the very best approach?

I do not want to lie, but don't wanna end up doing any stupid thing, I went to the local agency to get a print of my records and it shows "none / name completely clean"

What do you think?

To find out you will have to apply for the tourist visa. Prepare to meet strongest ties rule where you will demonstrate and provide evidence that you must return. Keep in mind cars can be sold, property can be sold and jobs replaced.

You say Argentina but you show Colombia. Which one is it? It does make a difference.

Argentina I erroneously choosed Colombia when registering from my phone, I will change that when I get home, thanks for pointing that out I did not even notice!

Ning, what would be the best way to go and what would I have to bring to the interview? A job letter? Will the VWP overstay or charges dropped years ago have a BIG impact on this?

VWP overstay does not help. You pay you money and you will find out.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Your chances are as good as anyone else, considering you will need to present proof of ties to Argentina, as would any other applicant. The warrant for your dad should not impact the application. Just be honest and truthful with the interviewer at the consulate and hope for the best.

Good luck!

What are the best proof of ties I could bring, Gegel?

Ideally a good paying job or one where your title is above management. In addition property deeds - house, condo - and a hefty bank account also helps. In other words, the consulate may ask for evidence that you have a lot of reasons to return home after your visit.

Chances are the your overstay is in the system somewhere and you must have disclosed previous visits to the US. Be prepared to discuss your overstay with the IO if/when asked.

Unfortunately there is no formula the will result in a visa. Have all documentation ready but don't shove it to the IO unless asked for it.

Thanks a bunch Gegel. Have a great day, I will let you know the outcome.
