Fiancee wants to go to work ASAP. Whats first?

My Fiancee will be arriving in AZ on 11-23-13, I believe the first step would be to apply for Social Security card in her present last name, then get married.

Any people who have gone through this, it would be appreciated if you could give instructions on what steps are required and about how long each step takes.

Does it usually take the whole 90 days after marriage to get the work permit?

The "whole 90 days after marriage" has nothing to do with anything.

With the K-1, you and your fiancee have to get marry within 90 days. That has nothing to do with a work permit.

After you get marry (it could be day 1 or day 90), you will need to file to adjust her status. She can apply for an Employment Authorization Document (EAD) which should come about 2-3 months after you file to adjust her status.

If you get marry on day 90, then expect the EAD to come 2-3 months after filing to adjust. That would mean 5-6 months where she is not allowed to work.

If you want her to get the EAD as soon as possible, then you want to get marry as soon as she gets here so you can file for the EAD.

A good source that my fiancee' (now wife) and I followed, after she arrived in the US, was the VJ K-1 flow chart... it can be found within the "Guides" link... or just clicking this link... http://www.visajourney.com/content/k1flow

I suggest getting her SS card before you get married (advice we received from someone at the SSA)... Then get married...

Married or not... Employment Authorization cards (EAD) are currently taking about 90 days to get one.

I suggest submitting the I-765 form WITH your I-485 AOS package... It probably won't speed up or slow down the time it takes for her to be able to work here legally, but it will save you at least $380.

Make sure you file I-485 (AoS), I-131(AP), and I-765 (EAD) all at the same time. That way you only have to pay the fee for the I-485. If you file them separately, you have to pay 3 fees.

My advise is meet her at the airport, then relax and spend some quality time together. You've earned it. The advise my wife got from the Thai girls here is town is don;t be in a big hurry to start working. She has her whole life for that. Enjoying getting to know each other for a few months can;t be a bad thing.

Meanwhile back at reality, ......

1) wait two weeks after arrival, then file for the SSN. Follow the guide here on VJ, it covers everything.

2) Contact your local county office about requirements to file for a marriage certificate.

3) Follow those requirements.

4) Start working on the AOS packet so you have it ready after the marriage

5) get married within 90 days of arrival.

6) have a big party, you earned it.

7) File AOS before her I-94 expires or as soon as possible after it expires.

8) wait...................... you should know how to do that by now. The Biometrics appt should come pretty quickly, the rest is up to your local USCIS office
