Hi there,

So I posted my initial I-129f a couple of weeks ago, and we had an email that the application was accepted. I presume we will get a hard copy in the mail but we are both out of the country right now so will find out when I get home. Is this what is commonly refferred to as the NOA1 and will the hard copy include instructions on how to proceed?

My main question is what happens now, is it just a case of waiting to be advised of the next step? Is there anything I should be doing to prepare for the interview etc.

Also I have read a lot about the i-134 form and wonder if my father can act as co-sponsor as I do not have evidence of tax returns, or will i need them for my own i134 regardless? if that will be necessary perhaps i can be using the time to gather this. What are the implications to my father if he takes on this role? My fiancé will have a good amount of savings by the time of the interview also, could she sponsor herself?

Really a brief guide to the steps that are to follow and how everything unfolds would be a great help from anyone who has experience.

Thanks so much :)

Hi! well to your 1st question yes, the hardcopy is the noa1. After that all you can basically do is WAIT. Regarding to the i134, you will definitely need a co sponsor and your dad can be one. Just make sure he meets the requirements. Download the i134 instructions and read them very carefully. And no, she cannot sponsor herself even if she has the money to prove it. You will need to prove that you and your co sponsor can take care of her and she won't be a public charge. Failing this requirement will be a denied visa.

In the mid time, you can do some things here and there, like getting all the vaccines she will need. She needs to go through an entire medical examination, where vaccines are a "requirement" (some people think they are for the k1 other's for the AOS) but the thing is now or later she will need them, eventually. She should get a copy of her vaccine record and check the ones the embassy requires. If she is missing one of them, most civil surgeons provide them. In my case (just my personal experiences) my local hospital (when I was living in my homecountry) provide them for free so I got them before coming to my medical appointment. That saved me a LOT of money, cause they charge you for every vaccine he thinks she needs.

My now hubby and I worked a lot gathering all the things that could proof we were and are a real couple. Now that you are traveling together keep all the receipts, boarding passes, airplane tickets, itineraries, hotel receipts, car rental etc etc. Besides pictures, emails, letter ect ect. Don't wait to the last minute to do this.

You have plenty of time, so get inform, READ, search...knowledge is power.

wish u the best of lucks

Thanks so much smile.png

A brief guide to the steps? Voila: http://www.visajourney.com/content/k1flow

Also, she could sponsor herself if she has 5 x the required amount of money accessible to her in the USA in cash (like in a bank account) or in other liquidable assets. She'd need $96,935. Some applicants in London recently did this successfully. It's an unusual path, but not impossible as the poster above suggested. London may even be able to take the 100% level as that's what's stated to be OK here: http://travel.state.gov/visa/immigrants/types/types_2994.html#8 (so she'd need $77550).

The poverty guideline amounts are here for 2013 (and I made the assumption of a household size of 2 - you and her.): http://www.uscis.gov/files/form/i-864p.pdf

My main question is what happens now, is it just a case of waiting to be advised of the next step?

There is a flowchart to see a general list of what happens. Pay no attention to the times given. They change all the time. It is general for the world. After NOA2, each consulate is different in the order and procedure. Flowchart http://www.visajourney.com/content/k1flow

Is there anything I should be doing to prepare for the interview etc

I posted a "to do" list just a few days ago. Read it here http://www.visajourney.com/forums/topic/461282-what-is-post-decision-activity/#entry6596643

Also I have read a lot about the i-134 form and wonder if my father can act as co-sponsor as I do not have evidence of tax returns, or will i need them for my own i134 regardless? if that will be necessary perhaps i can be using the time to gather this. Dad can sponsor instead of you. If you have income, but don't file taxes (that's how it sounds) then it is time to get that sorted. London does not require a tax return for the I-134 if you have other good proof of income. London allows the beneficiary to self-sponsor with cash assets or proof their same job/income will continue in the US. How much do you consider a "good amount of savings"? It is NOT 5 times the poverty guidelines, or even 3 times. There is no set amount so no guess what London would consider enough.

Reason you need to get taxes sorted if it is a case on not bothering to file-- when you get to Step 21 on the flowchart right after marriage your new wife has to adjust status. New affividavit of support that is much stricter...Form I-864. You have to file the form yourself and it does require a tax return unless you have a legal reason you were not required to file. Dad can be a joint sponsor, but without your forms and tax returns in addition to his, the application will be rejected.

It is NOT 5 times the poverty guidelines, or even 3 times. There is no set amount so no guess what London would consider enough.

My bad! And that's interesting. I assume aiming for 3 or 5 times would be a safer bet, though? Did we ever find out how much those that have managed to self-sponsor lately needed?

That is not correct for the I-134. That would be for a joint sponsor using assets on an I-864. A spouse on an I-864 is 3x. But an I134, especially in London, has no specific amount stated in the Foreign Affairs Manual. It says the officer must be convinced the beneficiary will not become a public charge. So it's how much will convince the officer? Around $40,000 has been accepted. Boiler thinks less than $10,000...well that's what I think he thinks.

Thank you all, Nich - Nick I can't find the to do list, is there a link?

It just hadn't shown up yet. Got it now thanks

You read it before my edit. Go back and find it.

Wow. $10,000 isn't all that much at all. Of course, the I-864 crops up so quickly after...

I wouldn't bet on $10k. But we don't really have anybody who has posted a small amount that was accepted.
