Can anyone help me with this question. My fiancee's visa has been approved and will arrive to the U.S. on December 12th. Now when we went through the Fiancee Visa Process, the I-129F Petition, I had to provide a affadavit of support along with a Co sponsor Affadavit of support seeing my income did not meet the eligibility requirements (I am retired, sole income in my social security pension). Anyways, everything went great on the interview and she was approved for the visa and is on her way.

My question is, now I am going through the I-485 application process (adjustment of status) for her to get her greencard once we marry on December 20th. Now, the documents, photos , everything forms I have to submit, also includes another affadavit of support. Can anyone please tell me why i have to provide two of these within a 7 month process.

When she lands in her first port here she has that sealed envelope she is to give to immigration which they keep they do not give it back to her. Within that sealed envelope if the affadavit of support from the I-129F petition. If immigration has this, why is another Affadavit of Support required for the Green card processing??? Financially, within the time i submitted the first affadavit, nothing has changed.

It seems like a lot of things i have to submit for the Adjustment of Status is all the same things I submitted for the I-129F petition. Can anyone tell me why two affadavit of supports are needed seeing when she arrives here in the U.S. she will be giving it to immigration, would this not be on file????

Hoping someone can explain why the U.S. Immigration makes you do the same requirements over for both processes, when all documents, photos, evidence, forms are all on file with the American consulate and the USCIS already.

Thank you for any answers you may have out there in Visajourney Land

The I134 was conducted overseas and is not legally binding. Different consulates have different requirements for the I134 (some allow self-sponsor, some only ask to see 100% of the poverty line). The I-134 is for the first 90 days only.

The I-864 is done in the US and is legally binding. It has the same requirements for everyone. It is good until the immigrant works 40 quarters in the US, or becomes a USC, or leaves the country, or dies.

Lots of reasons.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!
