What if I just want to go home...?

Timeline

Life in the US has been rough. I don't want to get into the details... but I just don't see my marriage as being a good decision anymore. I'm Canadian. What do I have to do if I want to go home?

My AOS has not been approved yet, but I have EAD/AP and SSN, and I've been working since June - you can see my timeline in my signature. All my US documents are in my married name. My Canadian documents are in my maiden name. My parents have a home in FL, so I want to be able to visit, with the same restrictions that I had before as a Canadian citizen (ie 180 days, no visa required, just a passport) - now my passport has my visa in it though, so do I somehow surrender it?

This may be a long shot, but does anyone know what (if anything) I will need to do when I'm back in Canada to get all my stuff activated (ie my OHIP/health insurance, SIN # ... do I need to file anything in Canada that states that I was married in the US?)

How about taxes for 2013? I am thinking the earliest I will be able to go home is February, so do I just file 2013 taxes in the US, and then somehow let them know that I'm moving back?

Those who have left that I am aware of, have crossed by land and mentioned it to the CBP when returning and they have been a great help, is that a possibility for you?

Yes, I would definitely be crossing by land, so I could talk to CBP. I'm mostly just not sure what I have to take care of before I leave (if I end up leaving, assuming my marriage doesn't work out)

You just leave. The visa was a single entry visa and is thus not valid anymore. Once back in Canada, you can go to the nearest US Consulate and turn in your AP/EAD and/or the GC if you get it by then. Then you are a typically Canadian citizen that wants to travel to the US. Sorry but I do not know what you need to do to get all the benefits of being a Canadian citizen moving back to Canada.

I hope you can work this out.

Thanks all.

Does anyone know about the name change aspect? Does it affect anything since all my Canadian documents are in my maiden name still, and I would be forfeiting all my US ones in my married name? Do I have to file anything in Canada that says I was married (I'm not sure exactly how long it takes to file for divorce, or if we will even do that right away, or hold off for a while...)

If you are wanting to go back to your maiden name then you don't need to do anything with your ID in Canada.

For OHIP I think you just need to wait 3 months, you can call them to see what proof they want to show your back and for the required time. Someone who did this recently may see this and give you better info. So start getting mail, change your drivers license back.

For 2013 taxes since you will still be in the US go ahead and do them then. Once you are back in Canada if you are not divorced by the time the taxes roll around you can claim as separated. Not sure what they mark but obviously you wont have your soon to be ex's tax info ( I used H&R block when I was separated and that is what they did). If you work at all in 2014 you will need to file both Canadian and US taxes to clear that up. Now I'm far from knowing anything about taxes that's why I payed someone to do mine :P

Your Sin # doesn't need you to do anything.

Make sure you keep a copy of your marriage certificate till you get your divorce decree so you can show, the name difference if you are even asked. Like maybe when you go to change your DL back and maybe they can issue it in your maiden name before you are divorced.

You are supposed to keep the CRA up to date on your marital status. You can do this by calling them, or there is a form that you can fill out and send in (it's on the CRA website--I can't remember the form name/# right now).

When you do your taxes in Canada, there is a part that will ask you about your marital status too.

6 Mar 2013 -- I130 transferred to Orlando local field office (which started the whole nightmare)

Mar 2013 to October 2013 no one would tell us where our case was or what was happening. I suspected the whole time it was just sitting in a corner somewhere in the Orlando field office. I was pretty much right.

October 2013 - get congressman involved. Congressman asks USCIS repeatedly about our case but they won't even tell them anything.

31 Jan 2014- finally get NOA2!!!! (we think the nightmare is over!)

NVC

Our case was not sent from the Orlando field office as it should have been. The nightmare continues. We kept calling NVC and asking if they received our case, and they always said "NO" and that we had to wait 90 business days for it to be received. We called USCIS during this time and they kept telling us it had been sent. After the 90 days of agonizing frustration, NVC then started telling us we had to wait 120 business days. I got our congressman involved again, and they told the congressman it was sitting at the Orlando office this whole time (just as I thought it was!).

16 May 2014 -- NVC case number assigned
24 May 2014 -- AoS and IV bills paid

28 May 2014 -- Sent AoS and IV Packages

6 June 2014 -- documents scanned

18 July 2014 -- false checklist from NVC

21 July 2014 -- Case complete

28 July 2014 -- receive case complete email from NV

30 July 2014 -- interview booked! September 11 here I come!

Establishing residency with OHIP (though this was years ago I had to deal with OHIP)...generally it's just some proof of residency...bills in your name to an address in Ontario, drivers licence, etc.
