Hello Ya'll!!!!

My wife filed and i130 petition on my behalf sometiime in March 2013 and filed an i129F subsequently after getting the NOA1 from filing the initial i130. We've not gotten any news about anything and checking online it states its still on initial review. Just recently she contacted her congress man in San Antonio and she was informed it has been moved from NBC to a local field office in vermont. I was thinking she was supposed to have been told or given some sort of notice to indicate the transfer or something. It was the intern at the congress man's office that called USCIS for update regarding our petition and was informed that our i130 has been moved. Also, she was duly informed by the intern that USCIS has stopped processing i129F! Is that true or we just getting screwed by USCIS/Congressman's intern?

I have read a few posts from others who spoke directly to tier 2 reps and it was suggested that they file a k-3... and this was only a few weeks back.... I think the information is all over the place. I recently filed a K-3 six months after my I-130 . I was informed by my lawyer that they are re-starting the K-3 processing.. so... I guess you have to go with your gut and do what is right for you !

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

an intern does not 'act', does not 'do stuff' with USCIS.

However, they do inquiries and report back to you.

So, learn more about the inquiry (what was asked) and the answer (what the response was).

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

I can't answer this question as I myself don't know. But, I have a question for u. How can u file an I-129F (fiance) and an I-130 (spousal) both in the same time frame? U can't be engaged and married to one person at the same time. Either, ur engaged or ur married. I'm curious because I have seen a lot of people do this. Won't one application impact the other?

Have you read up on he process? Click on the GUIDES link above and read up ! You can't file a K-3 WITHOUT first filing an I-130. K-3 is for married people.. smh

Yes what happened to your case is quite normal, including them not processing the I-129 (which is obsolete). Not being informed is a bit odd, but the online case updater doesn't always work.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I honestly wish people would stop saying the K-3 is obsolete.... IF that were the case, my lawyer would not have called me in to file it six months after I filed my I-130. ( PD 10-18-2013) So Telling people it is obsolete is falser than false... smh.

Many of us have been around for years and know how many K3 get through about 1% of all petitions if that You wasted your time and overpaid your lawyer

This will not be over quickly. You will not enjoy this.

He received notification ( and I was given a copy of the email notification ) that they were going to "re-start" processing the K-3's so he called all of his clients with pending I-130's and filed a K-3 for them. He didn't charge me anything extra. ( so money was not his motiovation) He told me it is his job to get us approved the fastest way possible. So that is what I'm going with. If K-3's were obsolete, don't you think they would remove the option from the official USCIS website? Don't you think they would stop reporting the K-3 processing times as 5 MONTHS?

It just makes sense to me to cover all your options. I'll take either/or... What ever one comes first.

No, I can do that myself.... I just need him for our special circumstance. Once my husband is here, We're good. We will have a year and 9 months to put aside the adjustment fee. yes.gifyes.gifyes.gif
