Hello!

I entered the USA on my k1 VISA September 10th, 2013...Married September 20th, 2013...went to file for i 485 and did NOT receive a letter for my fiance approval way back in April 2012.

Now filed i 824, was sent an RFE (request for evidence), becasuse my husband signed the wrong spot (holy moly)... so my question being,

I have school starting back up next September (11 months from now) to finish my degree in Canada... And I wanted to get my advanced parole to ensure that IF my GC wasnt approved yet, that I would have another proof of ability to cross.

So...Should I apply for my Advanced Parole seperately from my green card and pay the extra $360...Will it be valid?

I know you can only apply for it within 180 days of entry, but if it takes 3 months to receive... does that rule apply to when you applied or when you were approved?

Hopefully someone out there can help me...

Thanks

EAd and AP come as a package, most people would need at least one.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

There is no charge for AP (I-131) or an EAD (I-765) when filed concurrently with, or subsequent to, an I-485. Simply enclose a copy of your I-485 NOA with those applications to show that you are exempt from having to pay those fees.

Filing an I-485 places you in a new period of authorised stay, so provided it was less than 180 days between your I-94 expiring and the "received by" date on your I-485 NOA then you should be fine to use AP to re-enter the US until your I-485 is adjudicated.
