Here is my situation. My husband has been victim of an identity theft during this tax season. We file I-130 and I-485 concurrently in February 27, 2013.

The AOS interview was in may 31, but it is still in pending adjudication.

Happens that we have not received the refund of this year, because some one stole the identity of my husband and reported income taxes.

So, our reimbursement has been withheld until the situation is resolved. We reported our income taxes in March this year and our AOS application was in February.

Now, it come to my attention; could this be affecting the decision for my I-130 and I-485 approval?

I would appreciate any advice. Thank you.

My husband has made several call to the IRS and even went to the local IRS office to show all his documents. and nothing has been done.
