My father filed I-130 years ago for my brother who wasn't married then. When my brother went to filed he indicated he was married. What should he do should he get a divorce? His interview is coming up he was already thinking about divorce since the marriage not going well

Pls help what should he do

hi,

is your father a USC? if so, then he may have to wait more years depending on the country of origin, he cannot go to the interview as his category changed

now if your father is only a LPR. then the petition became voided the day he married, he will be denied because there was a marriage certificate, even if he were to divorce, he never should have married, Children of LPR must remain unmarried all the time.

what country is your brother from? what is his priority date?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Was your father an LPR when he filed for your brother?

Did your brother get marry while your father was an LPR?

With a scheduled interview, how is your brother going to get a legal divorce in time for his interview?

Did your brother mark that he was single on the DS-230?

When all process done when he still single adult child of LPR but then his scheduled for interview coming up,meanwhile your brother gets married to someone he loves so that would definitely his case will be void

once you say I do who someone you loved which mean " you don't the petition of your father.
