DS-260 Uses Married Name which is Different From Passport Name

Hi,

I petitioned I-130 for my wife early this year and now it has reached the point where we are about to submit the DS-260 online. Her hope is that she would like to use her married name (that is adding my last name to hers) in the States and so we filed the petition using her married name thinking that at that time, it would be not a problem to add my last name on her passport. But unfortunately, we now found out it is not possible according to the immigration department where my wife come from.

Does anyone has any experience like this? I am wondering whether there is any problem with submitting the DS-260 with her married name even though it doesn't match with the original name on her passport. Would the interview officer accept that or would/could the officer revise the name at the time of interview? I read in this forum too that upon arriving at POE, there could still be a chance to request the married name on the GC should the interview officer changed the name back to match her original passport name.

Any advise is greatly appreciated.

Hi Jim49! My case was the other way around. We submitted using my maiden name. But before the NVC stage I renewed my passport to my married name and I wanted to use my that We called NVC and they advised us to e-mail the copy of the passport to update the name in their database.

I suggest you call NVC also to know which steps you may take..
