MIL visa denied :(

Boo, my future MIL had her visa to come to our wedding denied due to "not having sufficient ties to Ukraine". She has a full-time job (though not really highly paid job as it's Ukraine) and owns an apartment in Dnipropetrovsk. She has no other kids to leave in Ukraine as hostages to ensure coming back. I hate this process sometimes...

1/4/13 - I129-F Sent | 1/8/13 - Received by USCIS
1/10/13 - NOA1 to VSC | 1/11/13 - Text/Email | 1/17/13 - Hard Copy Received
1/16/13 - Alien Registration Number changed
5/24/13 or 5/29/13 - Case Transferred to TSC
7/2/13 - NOA2 from TSC! (173 days from NOA1) | 7/6/13 - Hard Copy Received
7/18/13 - Shipped to NVC | 7/26/13 - Received at NVC and case number assigned
7/29/13 - In transit to consulate | 7/31/13 - Received by consulate
8/20/13 - Medical - Passed | 8/21/13 - Interview - Approved!
8/28/13 - Passport with visa ready to pickup from courier
10/17/13 - POE - JFK
10/28/13 - Applied for SSN and marriage license | 11/2/13 - SS card received

Sorry to hear about the denial. This process really makes no sense at times. Last month my MIL was approved when she had no ties and no reason to return. I guess it just really depends on the mood of the officer or maybe there's a quota that has to be met at each embassy. Who knows? Have her try again next year.

did you send a letter to her, or to the embassy in support of her Visa.? Would that help or hurt.?

I did for my MIL. They never looked at it and she didn't have stamps in the passport because she hadn't traveled in many years. Not really sure why they approve or deny but my guess is it depends on what side of the bed they wake up on lol.

As has been mentioned many many times it is not luck, there might be a few cases that could go either way but most are pretty obvious.

Please explain? I agree some could go either way but if MIL A has lots of home country ties and other reasons to return and MIL B has no ties and no reason to return but both have a 50/50 chance at getting a visa, how is it not luck?

This can be a key criterion. My in-laws traveled 14 hours by bus to the embassy, paid the expensive (for them) visa fees, and were dismissed after 2 minutes with the proverbial wave of the hand and a "visit another country first, then try again." They were subsequently approved, but I remain angry and mortified at how dismissively they were treated.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

it is not supposed to be a game.. but seemingly how some get denied and others approved.. how would you describe it..??

my wife came here, legally.. her sister wants to come visit and is preparing to apply for a Visa, but she may be denied.? why.??

she has a good job, owns her apartment, ect.. but she can still be denied a visa, all by the whim of an embassy employee..

she must prove strong ties to her country, but owning real estate doesn't count because that can be sold even if you live over seas, the embassy can decide that my sister-in-law is not close to her parents who remain in Russia. They can deny her even though she has a good steady job where she has worked for over 4 years, because they think this 30 year old Russian woman who doesn't speak English can get a better job here as an illegal immigrant.? And, the embassy will not consider any support letter I (USC) write.

the embassy will not consider it a good thing the fact that my wife came here legally.. This is the proof that we are good honest people who simply want to spend time with our family.

and one embassy employee can make the decision to approve/deny Visa without a really good reason..

How is this much different from a game.?

Did they visit another country and then reapply.?

How long after the first denial did they reapply.?

So why you are worried with all those ties? Obviously something is concerning you?

Does beg the question on how applications are reviewed, someone tossing a coin in the back office as you imply sounds unlikely.

No, I don't think that someone, spins a wheels, or tosses a coin... But approval of a tourist Visa seems to be subjective according to what the embassy employee "feels".... (according to what some people say)

and yes I am worried, because it is important to me, my wife, and daughter, that my sister-in-law be granted a Visa to come visit for a few weeks...

I wouldn't worry too much. This year our house has been like a hotel with seven different Russians visiting us. All ages from 26 to 57. No issues getting tourist visas from Russia for these friends of ours. A few had traveled before, but the others had not. The lady visiting now has a house, but a very low paying job and has not traveled outside of Russia. I really didn't think she would get a visa, but she got the three year visa with no problem.
