Hello,

My I-751 is pending for 2 years now(almost 3 next year). I am petitioned by my Stepmother (who is a US citizen) married by my Father, unfortunately my fathers I751 is also pending which im guessing affects my application. For the past 2 years I've been getting a stamp (I551) and we havent receive any notice. everytime i verify it with USCIS they tell me that its under review.. so currently i am just patiently waiting. but now i have an established career, finished college with school loans. I need to take an action. Since I am 22 years old, and by February i am a "permanent resident" for 5 years. Can i apply on my own to be a US citizen?. What are the pros and cons if i do this? will it affect my fathers and siblings I751 as well? is it helpful if a seek help with an immigration lawyer?

Please help me answer my questions.. so i can take necessary steps.. thank you all!!

You probably don't need a lawyer - usually they just take your money to do what you can do just as easily for yourself. So unless there's something complicated that you're not telling us, all of this is pretty straightforward - and I have no idea why it's taking so long... it really shouldn't have.

 

Whenever you're eligible to apply for citizenship, go ahead and do so... they won't approve your citizenship without approving the Removal of Conditions first, but sometimes a citizenship application can get the wheels moving again. (And if they're just covering for the fact that they've somehow lost your application, they'll have to find it!)

 

You should also get the USCIS Ombudsman involved... this is far too long to have to wait for an uncomplicated case. Also you can contact your Senators and Congresspeople to have them (or their staff) investigate what is taking so long.
