Hi folks.

Some of you may remember my story I poosted on here almost 2 years ago about my being scammed by a fraud Philippine citizen, here:

http://www.visajourney.com/forums/topic/348536-fraud-wife-being-removed-from-us/.

Basically she duped me and scammed me through 12+ years of marriage and dragged me through hell for divorcing her.

Well, the BIA has finally dismissed her case! What does dismiss mean? I know it is not favorable for her, but is is the same as a denial? Does she have any other recourse to continue to stay? I know she can appeal further to the 9th circuit court, but that doesnt meand that she can not be removed now. And hopefully it is a wake-up call to her for what she actually did.

Anyway, can anyone tell me what the next step in her removal be? She is not a criminal per se, so will DHS actively seek her out and pick her up to remove her, or will she be able to continue on living here in the US hoping she doesnt get stopped by the police or something?

Any other information that you can offer will be appreciated!

Thanks!

Are they going to look for her, no.

Stopped by the Police, most unlikely.

Commits a crime, well that would depend on the crime and where it was.

Driving License, well California will in future give her one.

Reading your previous threads, she currently has a deportation order on her. The appeals would have put a hold on the deportation order, but with no current appeal keeping a hold on it, they should be looking to pick her up. Its one thing to have ICE go hunting down people who have no legal status, they just don't do it. But when a deportation order is in effect, they will make some type of effort to pick her up. Although someone might have to wake them up that the deportation order is no longer being held on appeal, and where she currently is residing.
