cr-1 or k1,whats better plus other questions

Hi, I have a question about which process is better? k1 visa or CR-1 visa? pros and cons? also I had petitioned before for a k1 visa,it was approved but my ex girlfriend and I broke up around the time the petition was sent to the consulate,my question is: would that affect in any way when i send a new petition for my current girlfriend?

I forgot to ask,if I marry her by the church in Colombia,will that be considered marriage or not?

Go K-1. CR-1 is taking 12 months just to get through the USCIS part of the process, and then you have another 2-6 months for the National Visa Center and the consulate interview. It's terrible. I believe there is a maximum limit to the number of K-1s you can submit over a certain period, but I think you'd be fine with submitting your second. But don't quote me on that. Anyone else know about that?

You need to have your marriage recognized by the government of Colombia. Just having a church marriage doesn't mean anything to the U.S. Government. They want to see a governmental certificate showing your marriage, if you choose to go that route.

Did you file any paperwork or get a marriage license to have your wedding in a church?

If yes.. then you can't file for a K1. That is only for fiancees, you will have to go the CR1 route. If no official paperwork was filed and it was only a religious ceremony then technically you can file for a K1.

However, be very careful. They can deny you the K1 visa if they have the slightest suspicion that you might be legally married, and a church ceremony will raise suspicions.

The USCIS portion of the K1/CR1 is the same.. The additional time for the CR-1 is the USCIS-> NVC stage which normally adds about six weeks (The paperwork gets done at this stage for the CR-1 whereas the K-1 does this step after the person arrives in the states) . CR-1 is less expensive overall and does not have that additional round of paperwork after you get married or the requirement to get married 90 days after entering the country.

K-1 advantage: You will get them here six to eight weeks sooner.

CR-1 advantage: Less cost, no time constraints when they arrive, no extra round of paperwork when they arrive. CR-1s get approved at a higher rate (though for Colombia this is not really relevant), they get the GC, SSN, and the ability to work soon after they arrive.

You would have to add back in the time it actually takes to get married as you can't file the CR-1 until you are married. The K-1 could be filed today today.. One advantage there getting married in Colombia will likely be cheaper and allow his/her family to attend.

If you are already married the K-1 is no longer an option.

One disadvantage for the CR-1 in Colombia: Getting married as a foreigner there is a bit of a hassle compared to the states...

I never said 12 months for NOA2... Just that the NOA2 for the K-1 and CR-1 are the same basically the same.. I just looked at the timelines though and the I-129f (K-1) are reporting faster.. The CR-1s are all over the place anywhere from 2-8 months..

No they're not. Not one bit. That is very inaccurate.

The time to go from turning in docs to getting the NOA2 have traditionally been very close.. I can see the reporting is showing different right now (see post two up).. That is now, does not mean it will be the same next month. When I turned in Mine the times were running seven months but the majority turned in at that time completed in only 4-5.. Always always changing... They fall behind then make an effort to catch up then move on to another area and which cause one area to fall behind for a bit..

Yes, but since June or July the approvals have all but stopped and it looks like there's no end in sight. They've had 5 months to get their act together and they haven't. So obviously there's no hurry in getting anything change on their part. They don't care. It's not like it used to be and I-129Fs are getting approved 3 times as fast right now. You received yours at a time when I-130s were not being hampered by the DACA and Provision Waivers, which have backlogged the system severely. So comparing yours to now is not realistic.

How can you tell people this BS. Listening to people like you is what got me into this nightmare. All anyone has to do is vist the Febuary thru September I-130 Filers threads and you can see for yourself. So dont put out your standard line BS to people. USCIS turn around for a CR1-IR1 could be 12-16 months. K1 are 3-4 months then you wait for NVC 2-6 months.

You are turning in the the same basic information to the same location that will be processed by the same people - the only difference is how they choose to prioritize. It is a coin flip as to which will be faster because they can (and do) change how they prioritize constantly. You are basing your answer off nothing other that what is happening now and the recent past and assuming that is how it will be going forward.

Say I am turning in a I-129f or an I-130 today... If the NVC was backed up (taking longer than a few weeks to respond to new I-130s) I would put my money on the I-129f going through faster. If the NVC was caught up and looking for work then I would put my money on the I-130s. I-129fs done in the recent past seem to be going through faster now, that means nothing for one turned in today.

That is why when you go to the USCIS site right now they show the estimated processing times for both forms is exactly the same.

NVC ? why are you talking about the NVC when the USCIS is the problem. So lets say you do know and just made a mistake calling the USCIS the NVC. and Hoping that you do know something about this. Then what service center are you looking at that can tell you a I-129f (for a K1) and a I-130 (for a CR1) are processing at the same time? Please just tell me where to find this so I can go tell all the CR1/IR1 filers that they are just having a bad dream.
