Hi everyone,

I'm having a problem with my wife's I-130 application. You see, we're both here in Peru so our lawyer suggested that we send our application to my mom in Washington first so she could then send it for processing. We sent it to her late May. She then sent it on June 3rd to the Chicago lockbox. On June 12th I got my G-1145 email notification which stated that we should receive our Receipt Notice (Form I-797) within 7-10 days.

On July 16th our case status changed to this:

On July 16, 2013, the post office returned the notice we last sent you on this case I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN as undeliverable. This may have serious effects on processing this case. Please call 1-800-375-5283 to update your mailing address for this notice to be re-sent.

So of course I called them. They said that the problem was I tried having them mail the receipt here to Peru. So we changed the address to my mom's house in Washington and the gentleman told me to wait 10-15 days for the receipt to be resent. So I thought that was that. After 15 days we still had no receipt so I called again. This time someone told me it's supposed to take 15 days to one month and to please be patient. So after a month I called again. He told me not to worry and call again at the end of the month if we still haven't received it. Well being here in Peru I have to buy minutes in order to call to the U.S. And being that we still haven't received the receipt, I'm a little skeptical about continuing to call if I'm just wasting my time and money. The last time I tried calling they attempted to patch me through to another place where I could make my request. However there was over an hour of wait time and being that I'm in Peru I didn't think I would be able to schedule a callback. So my question is this, is there another way I can request that they resend our receipt? I'm worried that our case is being held up unnecessarily. And needless to say we would like it to be moving along as fast as possible.

I don't have a solution, but you may find using Skype to call them a cheaper alternative?

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

I might have to try that! My internet is a little choppy though, it likes to come and go as it pleases which might be a problem. But that's a great idea and I think I'll give it a go.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

A word of advice, if you are using an Iphone or a smartphone, try downloading MagicJack app.

I call NVC for FREE and line is still good on a 360kbps internet bandwidth.

Looks like to resolve your problem, you will need to keep calling them--at zero to minimal cost as much as possible. Good luck!

I call NVC for FREE and line is still good on a 360kbps internet bandwidth.

Thank you for the advice! I guess continuing to call is my only option. I will simply try to find the least expensive way to do so!
