Hi.

I want to send my I-864 off today but the more I look at the different options the more I get condused.

Scenario - I'm a British citizen whom entered US on K-1 in November '06 and married the same month. I am living with my wife. She earns below poverty level so we are using her mother who lives in a different state to be her joint sponsor. Both my wife and her mother are filing individual I-864 forms. I received her mothers today so will be sending that off in the packet.

Question 1 - Part 1 of I-864, does my wife tick 'a' (as she's the petitioner) or 'e' | 'first' as she is the first of 2 joint sponsors?

Question 2 - If she ticks 'e' she needs to include proof of citizenship, is her Birth Certificate OK?

Question 3 - Part 3, question 8, does my wife tick 'Yes' or 'No'? The instructions accompanying the form make it sound like 'Yes' is the correct answer as she is '...sponsoring the principal immigrant listed in item 2' whereas the form clearly has instructions about joint sponsors in parentheses after 'No'

Question 4 - Part 19, does my wife tick 'I am a US Citizen' (because she is) or 'I am a US National (for joint sponsors only)' because she is a joint sponsor?

Question 5 - Is my wifes pay stub proof of her occupation?

QUESTION 1) IF YOUR WIFE FILE YOUR I-130 FOR YOU THEN YES SHE IS YOUR PETITIONER THEREFORE SHE IS YOUR SPONSOR AND THAT'S WHAT SHE NEEDS TO PUT IN QUESTION 1

BUT IF SHE IS NOT YOUR PETITIONER IN FORM I-130 THAN SHE IS YOUR JOINT SPONSOR

QUESTION 2) IF SHE IS A US CITIZEN YES SHE NEEDS TO SEND COPY OF HER BIRTH CERTIFICATE

QUESTION 3) PART 3 QUESTION 8 THE ANSWER IS YES

QUESTION 4) OK WE GO BACK TO THE POINT IF YOUR WIFE FILE FOR YOU FORM I-130 THAN SHE IS YOUR SPONSOR AND IF SHE IS A US CITIZEN THAN SHE WOULD MARK " I AM A US CITIZEN

1) She is the petitioner, not the first of two joint sponsors (that would be like if your mother in law and another person were sponsoring along with your wife).

2) Birth certificate is perfect proof of citzenship - I know your mother in law will have to include that but I cannot for the life of me remember if we had to include it for myself (the petitioner, my husband is the immigrant).

3) I can't find what question you're talking about for question 3....elaborate more and maybe I can help on that.

4) Don't read too much into questions, if she is a US citizen then yes, of course you check that box :) All that means is that joint sponsors are allowed to be US Nationals whereas petitioners are not (whole other process to immigrate someone into US if it isn't a US citizen petitioning for them)

5) You need to include all of the employment info they request. I think that the employment letter is most important (IMO), and paystubs should only be sent in addition to that. Also, be SURE you include alllll of the tax information they ask for because believe me, there have been a whole lot of RFE's for that. You may still get an RFE but it's better to be sure you've sent it all to hopefully lessen those chances.
